                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION             April 14, 2023       TO: Honorable Abel Herrero, Chair, House Committee on Corrections     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB1563 by Harless (Relating to the confinement in a county jail of a person pending a transfer to the Texas Department of Criminal Justice and to the compensation for certain costs of confinement.), Committee Report 1st House, Substituted     No significant fiscal implication to the State is anticipated. The bill would require the Texas Department of Criminal Justice (TDCJ) to take custody of any person awaiting transfer to the department not later than the 45th day following the date on which all required documents have been received by the department. Under the bill, should the department not take custody within that timeframe, they would be required to compensate the county jail at a rate equal to cost TDCJ would have incurred for the confinement for that inmate.According to TDCJ, any costs associated with the bill could be absorbed using existing resources.  Local Government ImpactNo significant fiscal implication to units of local government is anticipated.
