The bill would amend Transportation Code, Section 545.353, to authorize the Texas Transportation Commission to adopt rules to establish a variable speed limit program to allow the temporary lowering of a prima facie speed limit to address certain road conditions, that affect the safe and orderly movement of traffic on a roadway for which the commission has the authority to establish a speed limit. The bill would require a speed limit established under the program to be based on an engineering and traffic investigation.  Based on the information provided by the Department of Transportation, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources.
