RULEMAKING AUTHORITY It is the committee's opinion that rulemaking authority is expressly granted to the Texas Transportation Commission in SECTION 1 of this bill. The bill requires such an established speed limit to be based on an engineering and traffic investigation, provides for it to be effective for all or a designated portion of the highway and for any period of the day or night, prescribes posting and signage requirements for it to be effective, and prohibits it from being less than 10 miles per hour below the prima facie speed limit on the portion of the highway to which it applies.
