A BILL TO BE ENTITLED
AN ACT
relating to the temporary use of average enrollment for purposes of
the public school finance system for a school district located in a
disaster area.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 48, Education Code, is
amended by adding Section 48.0061 to read as follows:
Sec. 48.0061. ENROLLMENT-BASED FUNDING DURING DISASTER.
Notwithstanding any other provision of this subchapter, for the
90-day period following the date on which a disaster area is
specified in a declaration of disaster under Chapter 418,
Government Code, the commissioner shall provide funding under
Chapter 46 and this chapter to a school district located wholly or
partly in the disaster area on the basis of the average number of
students enrolled in the district during that period.
SECTION 2. This Act takes effect September 1, 2023.
