                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION             May 15, 2023       TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB2700 by Guillen (Relating to prosecution of certain criminal offenses prohibiting sexually explicit visual material involving children.), As Engrossed     No significant fiscal implication to the State is anticipated. The bill would clarify the conduct constituting certain criminal offenses prohibiting sexually explicit visual material involving children to include a depiction of a child who is recognizable by certain features as an actual person and whose image as a child younger than 18 years of age was used in creating, adapting, or modifying the visual material. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.The Office of Court Administration anticipates no significant fiscal impact to the state court system. While it is assumed that any state revenue impact would not be significant, it would be dependent on the number of offenses committed and the associated court costs.  Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
