A BILL TO BE ENTITLED
AN ACT
relating to the adoption and amendment of an annual budget by
certain emergency services districts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 775, Health and Safety
Code, is amended by adding Section 775.079 to read as follows:
Sec. 775.079. ADOPTION AND AMENDMENT OF ANNUAL BUDGET IN
CERTAIN DISTRICTS. (a) This section applies only to a district
located wholly in a county with a population of more than three
million.
(b) The commissioners court shall establish a schedule for
districts located in the county to prepare an annual budget.
(c) The board shall prepare and approve the annual budget
according to the schedule under this section. The board may not
amend the annual budget at a time not provided for in the schedule
unless the amendment is approved at an election held in the manner
provided by this section.
(d) The board shall give notice of the election as provided
by Section 4.003, Election Code. The notice shall contain the
information required by Section 4.004, Election Code.
(e) The election shall be held in the district on the first
uniform election date provided by the Election Code after the date
of the board's order that allows sufficient time to comply with any
requirements of law.
(f) If a majority of the votes cast in the election favor the
amendment to the annual budget, the board shall implement the
amendment.
SECTION 2. This Act takes effect September 1, 2023.
