 A BILL TO BE ENTITLED
 AN ACT
 relating to motor vehicle safety inspections; authorizing a fee.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 548.002, Transportation Code, is amended
 to read as follows:
 Sec. 548.002.  DEPARTMENT RULES.  (a) The department may
 adopt rules to administer and enforce this chapter.
 (b)  A rule adopted under this section may not prohibit the
 holder of a vehicle inspection station license from refusing to
 inspect a vehicle.
 SECTION 2.  Section 548.501, Transportation Code, is amended
 to read as follows:
 Sec. 548.501.  INSPECTION FEES GENERALLY. (a) Except as
 provided by Section [Sections 548.503 and] 548.504, an inspection
 station may charge a fee for performing an [the fee for] inspection
 of a motor vehicle in an amount set by the operator of the
 inspection station [other than a moped is $12.50. The fee for
 inspection of a moped is $5.75].
 (b)  For each inspection performed at an inspection station
 under this section, [Out of each fee for an inspection,] $5.50 shall
 be remitted to the state under Section 548.509.
 SECTION 3.  Section 548.503, Transportation Code, is amended
 to read as follows:
 Sec. 548.503.  INITIAL TWO-YEAR INSPECTION OF PASSENGER CAR
 OR LIGHT TRUCK. (a) An inspection station may charge a fee for
 performing an [The fee for] inspection of a passenger car or light
 truck under Section 548.102 in an amount [shall be] set by the
 operator of the inspection station [department by rule on or before
 September 1 of each year. A fee set by the department under this
 subsection must be based on the costs of providing inspections and
 administering the program, but may not be less than $21.75].
 (b)  For each inspection performed at an inspection station
 under this section, [Out of each fee for an inspection under this
 section,] $14.75 shall be remitted to the state under Section
 548.509.
 SECTION 4.  This Act takes effect September 1, 2023.
