88R2128 JG-D By: Smith H.B. No. 3565 A BILL TO BE ENTITLED AN ACT relating to special reports of political contributions received by candidates for certain offices. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 254, Election Code, is amended by adding Section 254.0645 to read as follows: Sec. 254.0645. SPECIAL REPORT BY CERTAIN CANDIDATES. (a) In addition to other reports required by this chapter, the following candidates shall file additional reports with the commission during the period beginning January 1 and ending the ninth day before election day: (1) a candidate for state senator, state representative, or the State Board of Education who accepts during that reporting period political contributions from one person that in the aggregate exceed $10,000; and (2) a candidate for a statewide office who accepts during that reporting period political contributions from one person that in the aggregate exceed $25,000. (b) Each report under this section must include: (1) the amount of each political contribution; (2) the full name and address of the person making the political contribution; and (3) the date each political contribution was made. (c) A candidate who is required to file a report under this section shall file the report electronically, by telephonic facsimile machine, or by hand, in the form required by Section 254.036 not later than: (1) 5 p.m. of the first business day after the date the contribution is accepted, if the report is filed by telephonic facsimile machine or hand; or (2) midnight of the first business day after the date the contribution is accepted, if the report is filed electronically. (d) A report under this section is not required to be accompanied by the affidavit required under Section 254.036(h) or to be submitted on a form prescribed by the commission. A report under this section that complies with Section 254.036(a) must be accompanied by an affidavit under Section 254.036(c)(1), unless the candidate has submitted an affidavit under Section 254.036(c)(1) with another report filed in connection with the election for which a report is required under this section. (e) To the extent of a conflict between this section and Section 254.036, this section prevails. SECTION 2. This Act takes effect September 1, 2023.
