The bill would add an exception to the criminal offense of possessing or delivering drug paraphernalia for a person who uses, possesses with the intent to use, delivers, possesses with intent to deliver, or manufactures with intent to deliver testing equipment that identifies the presence of fentanyl, alpha-methylfentanyl, or any other derivative of fentanyl. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.  Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
