A BILL TO BE ENTITLED
AN ACT
relating to reliability programs adopted by the Public Utility
Commission of Texas for the ERCOT power region.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.159, Utilities Code, as added by
Chapter 426 (S.B. 3), Acts of the 87th Legislature, Regular
Session, 2021, is amended by adding Subsection (d) to read as
follows:
(d) The commission shall ensure that any commission program
adopted to comply with the requirements of this section that
assigns credits to or provides for capacity payments to generation
facilities includes credits or payments available to nuclear and
advanced nuclear generation facilities.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2023.
