 A BILL TO BE ENTITLED
 AN ACT
 relating to purposes for which certificates of obligation or tax
 anticipation notes may be authorized.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 271.043, Local Government Code, is
 amended by adding Subdivision (7-a) to read as follows:
 (7-a) "Public work":
 (A)  means, for a municipality or county, the
 following public improvements as authorized by law:
 (i)  Streets, roads, highways, bridges,
 sidewalks, landfills, parking structures, or airports;
 (ii Utility system, water supply project,
 water plant, wastewater plant, water and wastewater conveyance
 facility, wharf, dock, or flood control and drainage project;
 (iii)  Police stations, fire stations, or
 other public safety facilities, emergency shelters, jails,
 juvenile detention facilities, judicial facilities, animal
 shelters, libraries;
 (iv)  Administrative office buildings for
 housing governmental functions of a municipality or county; or
 (v)  Parks and recreation facilities that
 are generally accessible to the public and are dedicated as part of
 the municipal or county park system.
 (B)  does not include facilities for
 semi-professional or professional sports, stadia, arenas, civic
 centers, convention centers, hotels, or coliseums.
 SECTION 2.  Section 1431.001, Government Code, is amended by
 adding Subdivision (7) to read as follows:
 (7)  "Public work" for a municipality or county has the
 meaning assigned by Section 271.043(7-a), Local Government Code.
 SECTION 3.  The changes in law made by this Act apply only to
 a certificate of obligation or tax anticipation note issued on or
 after the effective date of this Act.  A certificate of obligation
 or tax anticipation note issued before the effective date of this
 Act is governed by the law in effect immediately before the
 effective date of this Act, and the former law is continued in
 effect for that purpose.
 SECTION 4.  This Act takes effect September 1, 2023.
