A BILL TO BE ENTITLED
AN ACT
relating to the award of attorney's fees in an action to enforce a
motor vehicle mortgagee's lien.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 61, Property Code, is amended by adding
Section 61.006 to read as follows:
Sec. 61.006. ATTORNEY'S FEES. The prevailing party in an
action to enforce this chapter is entitled to recover reasonable
attorney's fees.
SECTION 2. The change in law made by this Act applies only
to an action commenced on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
