A BILL TO BE ENTITLED
AN ACT
relating to the provision of full municipal services to a property
in a municipality's extraterritorial jurisdiction following the
municipality's denial of or refusal to permit an activity or
structure on the property.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter Z, Chapter 42, Local Government Code,
is amended by adding section 42.905to read as follows:
(a) If a municipality extends the application of an
ordinance to its area of extraterritorial jurisdiction and denies
or refuses to permit an activity or structure in that area, the
municipality shall provide the property on which the activity or
structure is proposed the municipal services described by Section
43.056(b) not later than 30 months after the date of the denial or
refusal.
SECTION 2. The change in law made by this Act applies only
to a municipal denial of or refusal to permit an activity or
structure on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
