A BILL TO BE ENTITLED
AN ACT
relating to participation in the wholesale electric market by a
municipally owned utility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter Z, Chapter 552, Local Government
Code, is amended by adding Section 552.9061 to read as follows:
Sec. 552.9061. PARTICIPATION IN WHOLESALE ELECTRIC MARKET.
Notwithstanding any other law, a municipally owned utility may not
sell electric energy at wholesale if the utility has, during the
preceding five municipal fiscal years, earned less revenue from
wholesale sales in the electricity market than the utility has
spent.
SECTION 2. The change in law made by this Act applies only
to a municipal fiscal year that begins on or after the effective
date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
