A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Aransas County Navigation District
to enter into certain leases.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 5001.101, Special District Local Laws
Code, is amended to read as follows:
Sec. 5001.101. PURCHASE OR LEASE OF PROPERTY. (a) Except
as provided by Subsections (b) and (c), the [The] district may
purchase or lease property in the same manner as a county.
(b) The district may lease the surface of land, including
submerged land, for not more than 90 years. The lease may not be
extended beyond the 90-year period by renewal, extension, or
otherwise.
(c) The district may not enter into or extend a lease of
property under this section for use in:
(1) the conduct of gaming or wagering activities
authorized under Subtitles A and A-1, Title 13, Occupations Code;
(2) the conduct of gambling prohibited under Chapter
47, Penal Code; or
(3) the establishment of a casino or other similar
gaming facility.
SECTION 2. This Act takes effect September 1, 2023.
