BILL ANALYSIS Senate Research Center S.B. 1216 88R10891 CJD-F By: Paxton State Affairs 3/17/2023 As Filed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT As proposed, S.B. 1216 amends current law relating to the issuance of a license to carry a handgun to certain active and retired judicial officers. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 411.201(a)(1) and (3), Government Code, as follows: (1) Redefines "active judicial officer" to include a person serving as a judge or justice of a statutory probate court. (3) Redefines "retired judicial officer" to include a visiting judge appointed to serve as the judge of a constitutional county court, a statutory county court, or a statutory probate court, rather than a visiting judge appointed under certain sections. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2023.
