                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION             May 8, 2023       TO: Honorable Dan Patrick, Lieutenant Governor, Senate     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: SB840 by West (Relating to increasing the criminal penalty for assault of certain hospital personnel.), As Passed 2nd House     No significant fiscal implication to the State is anticipated. The bill would increase the penalty for the offense of assault from a Class A misdemeanor to a third degree felony when the victim is a person the actor knows is hospital personnel while the person is located on hospital property, including all land and buildings owned or leased by the hospital. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant. The Office of Court Administration anticipates no significant fiscal impact to the state court system. While it is assumed that any state revenue impact would not be significant, it would be dependent on the number of offenses committed and the associated court costs.  Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
