Smithee, Chair, House Committee on Criminal Jurisprudence     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB1509 by Hickland (Relating to the offense of failure to stop or report aggravated sexual assault of a child; increasing a criminal penalty.), As Introduced     No significant fiscal implication to the State is anticipated. The bill would expand the conduct constituting the offense of failure to stop or report aggravated sexual assault of a child by allowing the prosecution of any persons who have a relationship with the child. The bill would furthermore increase the criminal penalty of the offense from a Class A misdemeanor to a third degree felony and allow for the prosecution for any other applicable statute.While it is assumed that any state revenue impact would not be significant, it would be dependent on the number of offenses committed and the associated court costs.  Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
