LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION March 19, 2025 TO: Honorable John T. Smithee, Chair, House Committee on Criminal Jurisprudence FROM: Jerry McGinty, Director, Legislative Budget Board IN RE: HB1631 by Gmez (Relating to the duration of a child's detention following a detention hearing and a study on the effects of detention orders in a juvenile court proceeding.), As Introduced No significant fiscal implication to the State is anticipated. It is assumed that any costs associated with the bill could be absorbed using existing resources. Local Government ImpactThere may be a negative fiscal impact to local courts and local juvenile probation departments, but the extent of the impact cannot be determined. Local juvenile probation departments (JPDs) may need additional probation staff to attend any additional hearings as required by the bill. JPDs may also need increased indigent defense budgets and travel budgets for departments without detention centers.Local courts may be required to hold additional hearings, held weekly instead of biweekly, which would add to court dockets and general workload.
