A BILL TO BE ENTITLED
AN ACT
relating to certificates of convenience and necessity for the
construction, ownership, or operation of facilities for the
transmission of electricity.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 37.056, Utilities Code, is amended by
adding Subsection (j) to read as follows:
(j) The commission may not grant a certificate to build,
own, or operate a facility that enables power to be imported into or
exported out of the ERCOT power grid if the effect of the granted
certificate would place facilities within the ERCOT power region
under the jurisdiction of the Federal Energy Regulatory Commission.
SECTION 2. This Act takes effect September 1, 2025.
