The bill would create an offense of intentionally releasing or causing the release of a balloon inflated with lighter-than-air gas outside a roofed structure subject to certain exceptions. The bill specifies criminal penalties for committing the offense ranging from a Class C misdemeanor to a state jail felony dependent on certain conditions and provides for enhancement to the next higher category in the case of a previous conviction for the offense, as well as reduced penalty if the offense is attempted or conspired.It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.  Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
