BILL ANALYSIS H.B. 3658 By: Morgan Insurance Committee Report (Unamended) BACKGROUND AND PURPOSE Under current law, an individual who holds a license as an insurance adjuster, among other license holders, must complete 24 hours of continuing education during the license period. However, the bill author has informed the committee that state law does not contain continuing education requirements specific to building codes or mitigation and reconstruction standards applicable to insured losses, but the majority of Texas policies that adjusters adjudicate involve the consideration of current building codes and standards, which are often complex and continuously updating, making it paramount for licensed insurance adjusters to receive at least one hour of continuing education on such codes. H.B. 3658 seeks to resolve this issue by requiring that at least one hour of a licensed insurance adjuster's continuing education in each licensing period include education on specified topics regarding state and local building codes. CRIMINAL JUSTICE IMPACT It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 3658 amends the Insurance Code to include among the required contents of a continuing education program for licensed insurance adjusters education relating to state and local building codes that is at least one hour in each licensing period and includes information relating to damage assessment and claim adjustment, policy coverage interpretations involving building codes, and mitigation and reconstruction standards applicable to insured losses. The bill requires the Texas Department of Insurance, in relation to a course instructing an adjuster on those building code requirements, to do the following: develop the course or certify a continuing education program with the course; and ensure that the course is available through continuing education program providers in multiple formats, including a classroom setting, an online setting, and self-paced study. EFFECTIVE DATE September 1, 2025.
