Smithee, Chair, House Committee on Criminal Jurisprudence     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB3694 by Raymond (Relating to the unlawful production or distribution of certain sexually explicit media and to the removal of certain intimate visual depictions published on online platforms without the consent of the person depicted; increasing criminal penalties.), As Introduced     No significant fiscal implication to the State is anticipated. Among other provisions, the bill would amend the offense of unlawful production or distribution of certain sexually explicit videos by expanding the conduct constituting the offense to include media that was created or altered using certain computer generated or technological means, that appears to a reasonable person, to depict a real person with intimate parts or performing certain actions indistinguishable from an authentic visual depiction without the person's consent. The bill specifies that the criminal penalty can be a state jail felony or a third degree felony depending on the offense and certain circumstances.It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.    Local Government ImpactIt is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
