Smithee, Chair, House Committee on Criminal Jurisprudence     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB380 by Guillen (relating to certain statutes of limitations for criminal offenses, including the statute of limitations for the offense of improper relationship between educator and student, and to the applicability of sex offender registration requirements for the offense of improper relationship between educator and student.), Committee Report 1st House, Substituted     The fiscal implications of the bill cannot be determined due to the number of cases and defendants with qualifying offenses impacted by the provisions of the bill being unknown.  The bill would amend the Code of Criminal Procedure to revise the statutes of limitations for the prosecution of certain offenses. The bill would also amend the list of offenses deemed reportable for the purposes of certain sex-offender registration statutes. The Office of Court Administration (OCA) does not have the case-level data to estimate the effects of the bill on court dockets or the potential fiscal impact on the state court system.
