According to the Health and Human Services Commission (HHSC), the agency would not be able to implement the provisions of the bill because federal law requires private duty nursing services to be provided by only a registered nurse or a licensed practical nurse. The bill would allow certain Medicaid recipients to receive private duty nursing services from a certified complex care aide, require the Health and Human Services Commission (HHSC) to provide reimbursement for such services, and establish requirements related to the provision of such services.The bill would take effect September 1, 2025.According to HHSC, the agency would not be able to implement the provisions of the bill because federal law requires private duty nursing services to be provided by only a registered nurse or a licensed practical nurse.
