                    BILL ANALYSIS        Senate Research Center   S.B. 1434     89R7313 TSS-D   By: Bettencourt         State Affairs         3/11/2025         As Filed          AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   S.B. 1434 codifies an attorney general's opinion request from 2018 and bans the use of public funds to transport district students or employees to or from a building or location selected as a polling place under the Election Code on the day of an election or while early voting is in progress. However, this would not apply to the transportation of students to or from their campus that they regularly attend or a school-sponsored activity.   As proposed, S.B. 1434 amends current law relating to a prohibition on the use of public money by a school district to transport district students or employees to or from a polling place.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Subchapter D, Chapter 11, Education Code, by adding Section 11.1691, as follows:   Sec. 11.1691. USE OF PUBLIC MONEY FOR TRANSPORTATION TO OR FROM POLLING PLACE PROHIBITED. (a) Prohibits the board of trustees of a school district, except as provided by Subsection (b), from using public money to transport district students or employees to or from a building or location selected as a polling place under the Election Code on the day of an election or while early voting is in progress.   (b) Provides that Subsection (a) does not apply to the transportation of students to or from the students' campus of regular attendance or a school-sponsored activity.   SECTION 2. Effective date: September 1, 2025.

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1434 codifies an attorney general's opinion request from 2018 and bans the use of public funds to transport district students or employees to or from a building or location selected as a polling place under the Election Code on the day of an election or while early voting is in progress. However, this would not apply to the transportation of students to or from their campus that they regularly attend or a school-sponsored activity.

 

As proposed, S.B. 1434 amends current law relating to a prohibition on the use of public money by a school district to transport district students or employees to or from a polling place.

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter D, Chapter 11, Education Code, by adding Section 11.1691, as follows:

 

Sec. 11.1691. USE OF PUBLIC MONEY FOR TRANSPORTATION TO OR FROM POLLING PLACE PROHIBITED. (a) Prohibits the board of trustees of a school district, except as provided by Subsection (b), from using public money to transport district students or employees to or from a building or location selected as a polling place under the Election Code on the day of an election or while early voting is in progress.

 

(b) Provides that Subsection (a) does not apply to the transportation of students to or from the students' campus of regular attendance or a school-sponsored activity.

 

SECTION 2. Effective date: September 1, 2025.
