89R13158 JAM-D By: Hall, Middleton S.B. No. 1694 A BILL TO BE ENTITLED AN ACT relating to the source of power for stations and other equipment used to dispense energy to electric vehicles. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 2311, Occupations Code, as added by Chapter 211 (S.B. 1732), Acts of the 88th Legislature, Regular Session, 2023, is redesignated as Chapter 2311A, Occupations Code, and amended to read as follows: CHAPTER 2311A [2311]. ELECTRIC VEHICLE CHARGING STATIONS Sec. 2311A.001 [2311.001]. ELECTRIC VEHICLE CHARGING STATION STANDARDS. (a) This section applies only to an electric vehicle charging station that is: (1) installed after December 1, 2024; (2) made available to the public; (3) not intended primarily for private use; and (4) funded through public grants or state rebate programs. (b) The Texas Department of Licensing and Regulation, in consultation with the Texas Department of Transportation, shall adopt standards for electric vehicle charging stations that require the charging stations to be: (1) equipped with a standard electric vehicle charging connector or plug type that is widely compatible with as many electric vehicles as practicable; and (2) powered only by renewable energy sources. SECTION 2. Section 2311.0301, Occupations Code, is amended to read as follows: Sec. 2311.0301. DUTIES OF ELECTRIC VEHICLE SUPPLY PROVIDER. Unless electric vehicle supply equipment is exempt from the application of this chapter or has been removed from service, an electric vehicle supply provider shall: (1) have electric vehicle supply equipment inspected as prescribed by commission rule; [and] (2) maintain electric vehicle supply equipment in compliance with maintenance specifications, this chapter, and commission rule; and (3) ensure that the electric vehicle supply equipment is powered only by renewable energy sources. SECTION 3. To the extent of any conflict, this Act prevails over another Act of the 89th Legislature, Regular Session, 2025, relating to nonsubstantive additions to and corrections in enacted codes. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
