Students are engaging in disruptive behavior and some students are even lashing out in violence against teachers. Unfortunately, some schools have discouraged teachers from removing problematic students from the classroom. S.B. 1874 ensures that a teacher may not be subject to disciplinary proceedings if the teacher reports a violation of Chapter 37, Education Code, to another professional employee of a school district, the Texas Education Agency, or a law enforcement agency, or if the teacher takes an action in compliance with Chapter 37. This bill provides teachers with the reassurance that they should follow school discipline laws without fear of reprisals from uncooperative school administrators. As proposed, S.B. 1874 amends current law relating to immunity from certain disciplinary proceedings against a professional employee of a school district for certain actions concerning public school discipline and law and order. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 22, Education Code, by adding Section 22.05121, as follows: Sec. 22.05121. IMMUNITY FROM DISCIPLINARY PROCEEDINGS FOR ACTIONS RELATED TO DISCIPLINE AND LAW AND ORDER. Defines "disciplinary proceeding." (b) Prohibits a professional employee of a school district from being subject to disciplinary proceedings for the reporting of a violation of Chapter 37 (Discipline; Law and Order) to another professional employee of a school district, the Texas Education Agency, or a law enforcement agency, or an action taken in compliance with Chapter 37. (c) Provides that the immunity provided by Subsection (b) is in addition to any other immunity provided by law. Prohibits this section from being construed to interfere with any other immunity provided by law. SECTION 2. Provides that this Act applies to a disciplinary proceeding for conduct that occurs before, on, or after the effective date of this Act, except that a disciplinary proceeding finally resolved before the effective date of this Act is unaffected by this Act. SECTION 3. Effective date: upon passage or September 1, 2025.
