                    BILL ANALYSIS        Senate Research Center   S.B. 1884         By: Sparks         Education K-16         4/24/2025         As Filed          AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   The State Board of Education (SBOE) is made up of 15 members, each representing around 1.8 million Texans. SBOE is tasked with setting curriculum standards and reviewing and adopting instructional materials. Additionally, the state legislature has increasingly passed new laws and directives for SBOE to comply with. The chair of SBOE is tasked with overseeing compliance of these directives, the regular duties of SBOE, and the needs of constituents.    Despite this, the chair of SBOE is not permitted to hire staff. Comparatively, members of the legislature represent fewer people but can still employ staff.    S.B. 1884 seeks to aid the chair of SBOE with the performance of their duties by allowing them to hire staff.    As proposed, S.B. 1884 amends current law relating to the employment of persons by the State Board of Education.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.    SECTION BY SECTION ANALYSIS   SECTION 1. Amends Subchapter D, Chapter 7, Education Code, by adding Section 7.114, as follows:    Sec. 7.114. PERSONNEL. (a) Authorizes the chair of the State Board of Education (chair) to employ personnel as necessary to assist the State Board of Education (SBOE) in performing its duties and to prescribe the personnel's duties and compensation as provided by legislative appropriation.   (b) Provides that a person employed under this section is considered an employee of the Texas Education Agency (TEA) for the purpose of receiving state employment benefits, including health insurance and retirement benefits, entitled to reimbursement for expenses incurred by the person in the performance of official duties as provided by legislative appropriation, and directly accountable to the chair.   (c) Authorizes the chair to make all employment actions regarding the status of a person employed under this section, including the hiring, promotion, or termination of the person.   (d) Requires TEA to provide administrative support services, including human resources, budgetary, accounting, purchasing, payroll, information technology, and legal support services, to SBOE as necessary to carry out the purposes of this section.   SECTION 2. Effective date: September 1, 2025.
