                    BILL ANALYSIS        Senate Research Center   S.B. 2075     89R12171 JON-F   By: Zaffirini         Business & Commerce         4/11/2025         As Filed          AUTHOR'S / SPONSOR'S STATEMENT OF INTENT The Texas Department of Licensing and Regulation (TDLR) oversees 32 advisory boards, but inconsistencies in statutory language have created inefficiencies in their governance. Specifically, term lengths for board members and presiding officers vary, and outdated terminologysuch as references to "committees" instead of "boards"create confusion. What's more, the definition of "advisory board" lacks uniformity across statutes, leading to administrative inconsistencies. To address these issues, TDLR has recommended standardizing advisory board governance.    Accordingly, S.B. 2075 would standardize advisory board governance across all 32 TDLR-regulated boards by establishing staggered six-year terms for advisory board members and setting presiding officer terms at two years. It also would define "advisory board" as an entity advising the Texas Commission on Licensing and Regulation and TDLR, removing inconsistent references to "committees," "councils," or other entities. What's more, the bill would replace all instances of "committee" with "board" where applicable. Importantly, this bill would not change the number of board members or their compositiononly their term structures and statutory references. By streamlining advisory board governance, S.B. 2075 would enhance operational efficiency, reduce administrative inconsistencies, and provide clarity in TDLR's oversight.    As proposed, S.B. 2075 amends current law relating to the establishment, powers and duties, terms, and governance of certain advisory bodies for programs administered by the Texas Department of Licensing and Regulation.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amend Section 301.053, Agriculture Code, as follows:   Sec. 301.053. New heading: ADVISORY BOARDS. Authorizes the Texas Department of Licensing and Regulation (TDLR) to establish advisory boards, rather than advisory committees, to advise TDLR and to make recommendations to TDLR concerning legislation, policies, administration, research, and other matters related to the duties, powers, or functions of TDLR under Chapter 301 (Weather Modification and Control).   SECTION 2. Amends Section 1001.058, Education Code, as follows:   Sec. 1001.058. New heading: ADVISORY BOARD. (a) Requires the Texas Commission of Licensing and Regulation (TCLR) to establish an advisory board to advise TCLR and TDLR on rules and educational and technical matters relevant to the administration of Chapter 1001 (Driver and Traffic Safety Education).   (b) Makes a conforming change to this subsection.    (c) Requires the presiding officer of TCLR (presiding officer) to appoint the presiding officer of the advisory board, rather than the advisory committee, for a term of two years. Makes conforming changes.    (d) Redesignates Subsection (e) as Subsection (d). Deletes existing text prohibiting a member of the advisory board from serving two consecutive full terms.    (e)-(g) Makes conforming and nonsubstantive changes to these subdivisions.   SECTION 3. Amends Section 469.053, Government Code, as follows:   Sec. 469.053. New heading: ADVISORY BOARD; TERMS; MEETINGS; REVIEW OF AND COMMENT ON RULES. (a) Makes conforming changes to this subsection.   (b) Provides that members of the advisory board for the architectural barriers program serve staggered six-year terms. Deletes existing text providing that a committee member serves at the will of the presiding officer.   (c)-(d) Makes conforming changes to these subsection.   (e) Redesignates Subsection (g) as Subsection (e) and makes a conforming change.   Deletes existing text of existing Subsection (f) requiring the committee periodically to review the rules relating to the architectural barriers program and recommend changes in the rules to TCLR.    SECTION 4. Amends Section 754.012(b), Health and Safety Code, as follows:   (b) Authorizes a member of the elevator advisory board to be removed from the advisory board as provided by Section 51.209 (Advisory Boards; Removal of Advisory Board Member), Occupations Code. Deletes existing text providing that board members serve at the will of TCLR.    SECTION 5. Amends Section 51.001(1), Occupations Code, to redefine "advisory board."   SECTION 6. Amends Subchapter D, Chapter 51, Occupations Code, by adding Section 51.2094, as follows:   Sec. 51.2094. PROGRAM ADVISORY BOARDS. (a) Authorizes TCLR to establish an advisory board to advise TCLR or the Texas Department of Licensing and Regulation (TDLR) regarding a program subject to regulation by TDLR.   (b) Authorizes TCLR, unless otherwise provided by a law established a regulatory program administered by TDLR, to establish the number of advisory board members, provided that the number of members are required to be an odd number of three or more, the qualifications for an advisory board member, and the terms of advisory board members.   (c) Requires members of an advisory board, unless otherwise provided by a law establishing a regulatory program administered by TDLR, to be appointed by the presiding officer with TCLR's approval.    (d) Requires the presiding officer, on approval of TCLR, unless otherwise provided by a law establishing a regulatory program administered by TDLR, to designate a member of the advisory board to serve as the presiding officer of the advisory board for a two-year term. Authorizes the presiding officer of the advisory board to vote on any matter before the advisory board.    SECTION 7. Amends Section 203.055(a), Occupations Code, to delete existing text providing that the terms of three members of the midwives advisory board expire on January 31 of each odd-numbered year.    SECTION 8. Amends Section 203.056, Occupations Code, to require the presiding officer to designate a member of the midwives advisory board to serve as the presiding officer of the advisory board to serve for a term of two years, rather than one year.   SECTION 9. Amends Section 401.105(a), Occupations Code, to delete existing text providing that the terms of three members of the speech-language pathologists and audiologists advisory board expire September 1 of each odd-numbered year.    SECTION 10. Amends Section 401.107(a), Occupations Code, to require the presiding officer to designate a member of the speech-language pathologists and audiologists advisory board to serve as the presiding officer of the advisory board for a term of two years, rather than one year.   SECTION 11. Amends Section 402.055(a), Occupations Code, to deletes existing text providing that the terms of three members of the hearing instrument fitters and dispensers advisory board expire on February 1 of each odd-numbered year.   SECTION 12. Amends Section 402.057, Occupations Code, to require the presiding officer to designate a member of the hearing instrument fitters and dispensers advisory board to serve as the presiding officer of the advisory board for a term of two years, rather than one year.   SECTION 13. Amends Section 403.051, Occupations Code, as follows:   Sec. 403.051. New heading: ADVISORY BOARD. Makes a conforming change to this section.    SECTION 14. Amends Section 451.053(a), Occupations Code, to delete existing providing that members of the board of athletic trainers serve staggered six-year terms.    SECTION 15. Amends Section 451.055, Occupations Code, to require the presiding officer to designate a member of the board to serve as the presiding officer of the athletic trainers board for a two-year, rather than a one-year, term.   SECTION 16. Amends Section 455.103(a), Occupations Code, to delete existing text providing that the terms of three members of the massage therapy advisory board expire September 1 of each odd-numbered year.    SECTION 17. Amends Section 455.104(a), Occupations Code, to require the presiding officer to designate a member of the advisory board to serve as the presiding officer of the massage therapy advisory board for a term of two-years, rather than one year.    SECTION 18. Amends Section 506.103(a), Occupations Code, to delete existing text providing that members of the behavior analyst advisory board serve staggered six-year terms, with the terms of three members expiring February 1 of each odd-numbered year.   SECTION 19. Amends Section 506.104, Occupations Code, to require the presiding officer to designate a member of the advisory board to serve as the presiding officer of the behavior analyst advisory board for a term of two years, rather than a term of one year.    SECTION 20. Amends Section 605.055(a), Occupations Code, to delete existing text providing the terms of two or three members of the orthotists and prosthetists advisory board expire on February 1 of each odd-numbered year.    SECTION 21. Amends Section 605.056, Occupations Code, to require the presiding officer, with TCLR's approval, to designate a member of the orthotists and prosthetists advisory board to serve as the presiding officer of the advisory board for a term of two year, rather than one year.   SECTION 22. Amends Section 701.054(a), Occupations Code, to delete existing text providing that the terms of three members of the dietitians advisory board begin on September 1 of each odd-numbered year.   SECTION 23. Amends Section 701.057, Occupations Code, to require the presiding officer to designate a member of the dietitians advisory board as the presiding officer of the advisory board to serve for a term of two years, rather than one year.   SECTION 24. Amends Section 802.065, Occupations Code, as follows:   Sec. 802.065. New heading: ADVISORY BOARD. (a) Makes a conforming change to this subsection.    (b) Makes a conforming change to this subsection.    (c) Provides that members of the dog or cat breeders advisory board serve staggered six-year terms rather than members of the advisory committee serve staggered four-year terms.   (d) Makes conforming changes to this subsection.   (e)-(i) Makes conforming and nonsubstantive changes to these subsections.   SECTION 25. Amends Section 1151.002(7-b), Occupations Code, to make a conforming change.    SECTION 26. Amends Subchapter B, Chapter 1151, Occupations Code, to read as follows:   SUBCHAPTER B. New heading: TEXAS TAX PROFESSIONAL ADVISORY BOARD   Sec. 1151.051. MEMBERSHIP. (a) Makes a conforming change to this subsection.   (b) Makes a conforming change to this subsection.   (c) Requires the presiding officer to designate one member of the Texas tax professional advisory board, rather than the committee, as the presiding officer to serve a two-year term.   (d)-(e) Makes a conforming change to these subsections.    Sec. 1151.0511. PUBLIC MEMBER ELIGIBILITY. Makes conforming changes to this section.    Sec. 1151.0512. MEMBERSHIP AND EMPLOYEE RESTRICTIONS. (a) Makes no changes to this subsection.    (b)-(c) Makes conforming changes to these subsections.   Sec. 1151.052. TERMS. Provides that board members serve staggered six-year terms, rather than serve six-year terms, with the terms of one or two members expiring on March 1 of each odd-numbered year. Makes conforming changes.   Sec. 1151.055. COMPENSATION; REIMBURSEMENT. Makes conforming and nonsubstantive changes.    SECTION 27. Makes a conforming change to this section.    SECTION 31. Amends Section 1302.201, Occupations Code, as follows:   Sec. 1302.201. ADVISORY BOARD MEMBERSHIP. Provides that the air conditioning and refrigeration contractors advisory board consists of nine members appointed by the presiding officer, with TCLR's approval, rather than the nine members appointed by the presiding officer, with TCLR's approval, and two ex officio nonvoting members.    SECTION 32. Amends Section 1302.205(a), Occupations Code, to delete existing text providing that the terms of two appointed members of the air conditioning and refrigeration contractors advisory board expire on February 1 of each odd-numbered year.    SECTION 33. Amends Section 1305.052(a), Occupations Code, to provide that advisory board members serve staggered terms of six years, rather than with the terms of three members of the electricians advisory board expiring on February 1 of each odd-numbered year.    SECTION 34. Amends Section 1305.053, Occupations Code, to require the presiding officer to appoint one of the electricians advisory board members to serve as presiding officer of the electricians advisory board for a term of two years, rather than a term of one year.   SECTION 35. Amends Section 1603.053(a), Occupations Code, to delete existing text providing that members of the barbering and cosmetology advisory board serve staggered six-year terms, with the terms of three members expiring January 31 of each odd-numbered year.    SECTION 36. Amends Section 1802.102(a), Occupations Code, to provide that the auctioneers advisory board consists of seven members appointed as follows one member who represents an auction school, rather than the administrative head, or the administrative head's designee, of any state agency or office that is selected by TCLR.    SECTION 37. Amends Sections 1802.103 and 1802.104, Occupations Code, as follows:   Sec. 1802.103. TERMS; VACANCIES. Provides that auctioneers advisory board members serve staggered six-year terms. Requires the presiding officer, with TCLR's approval, if a vacancy occurs during a member's term, to appoint a replacement to serve for the remainder of the term. Makes a nonsubstantive change.   Deletes existing text providing that auctioneers advisory board members serve six-year terms that expire on September 1 of each odd-numbered year. Deletes existing text prohibiting members from serving more than two consecutive terms. Deletes existing text requiring the presiding officer, with TCLR's approval, if a vacancy occurs during the term of such a member, to appoint a replacement to serve for the remainder of the term.   Sec. 1802.104. PRESIDING OFFICER. Deletes existing text prohibiting the presiding officer from serving more than two consecutive terms.    SECTION 38. Amends Section 1901.001(3), Occupations Code, to make conforming changes.   SECTION 39. Amends the heading Subchapter C, Chapter 1901, Occupations Code, as follows:   SUBCHAPTER C. New heading: TEXAS WATER WELL DRILLERS ADVISORY BOARD   SECTION 40. Amends Section 1901.101, Occupations Code, as follows:   Sec. 1901.101. New heading: BOARD MEMBERSHIP. (a) Provides that the Texas Water Well Drillers Advisory Board, rather than the Texas Water Well Drillers Advisory Council, consists of nine members appointed by the presiding officer, with TCLR's approval, as follows, certain members who are drillers experienced and certain public members.   (b) Makes no changes to this subsection.   (c) Makes conforming changes to this subsection.    SECTION 41. Amends Section 1901.102(b), Occupations Code, to make a conforming change.    SECTION 42. Amends Section 1901.103, Occupations Code, to make conforming changes.    SECTION 43. Amends Section 1901.104, Occupations Code, to provide that Texas water well drillers board members, rather than council members, serve staggered six-year terms expiring September 15.    SECTION 44. Amends Section 2308.052(a), Occupations Code, to provide that vehicle towing and booting advisory board members serve staggered terms of six years, rather than with the terms of two or three members, as appropriate, expiring on February 1 of each odd-numbered year.    SECTION 56. Amends Section 2308.053, Occupations Code, to require the presiding officer to appoint one of the vehicle towing and booting advisory board members to serve as presiding officer of the advisory board for a term of two years rather than a term of one year.   SECTION 57. Amends Section 2309.052(a), Occupations Code, to provide that used automotive parts recyclers advisory board members serve staggered terms of six years, rather than with the terms of one or two members expiring on February 1 of each odd-numbered year.    SECTION 58. Amends Section 2309.053, Occupations Code, to require the presiding officer to appoint one of the used automotive parts recyclers advisory board members to serve as presiding officer of the advisory board for a term of two years, rather than for a term of one year.    SECTION 59. Amends Section 2310.033(a), Occupations Code, to provide that members of the motor fuel metering and quality board serve staggered six-year terms rather than with the terms of three or four members expiring on February 1 of each odd-numbered year.    SECTION 60. Amends Section 2310.034. Occupations Code, to require the presiding officer, with the approval of TCLR to appoint one of the motor fuel metering and quality board members to serve as presiding officer of the board for a term of two years, rather than of one year.    SECTION 61. Amends Sections 662.0037(c) and (e), Transportation Code, as follows:   (c) Provides that the motorcycle safety advisory board members serve staggered six-year terms. Deletes existing text providing that the terms of three members expire September 1 of each odd-numbered year.    (e) Requires the presiding officer, on approval of TCLR, to designate a member of the motorcycle safety advisory board to serve as the presiding officer of the advisory board for two years, rather than for a one-year term.   SECTION 62. Repealer: Section 506.103(b) (relating to prohibiting a member of the behavior analyst advisory board from serving more than two consecutive six-year terms), Occupations Code.   Repealer: Section 605.059 (Meetings), Occupations Code.   Repealer: Sections 1302.203 (Ex Officio Members) and 1302.208 (Meetings), Occupations Code.    Repealer: Section 1305.052(b) (relating to prohibiting a member of the electricians advisory board from serving more than two consecutive terms), Occupations Code.    Repealer: Section 1901.106 (Grounds For Removal), Occupations Code.    Repealer: Section 2308.052(b) (relating to prohibiting a member of the vehicle towing and booting from serving more than two full consecutive terms), Occupations Code.    Repealer: Section 2309.052(b) (relating to prohibiting a member of the used automotive parts recyclers from serving more than two full consecutive terms), Occupations Code    SECTION 63. Effective date: September 1, 2025.

SECTION 9. Amends Section 401.105(a), Occupations Code, to delete existing text providing that the terms of three members of the speech-language pathologists and audiologists advisory board expire September 1 of each odd-numbered year. 

 

SECTION 10. Amends Section 401.107(a), Occupations Code, to require the presiding officer to designate a member of the speech-language pathologists and audiologists advisory board to serve as the presiding officer of the advisory board for a term of two years, rather than one year.

 

SECTION 11. Amends Section 402.055(a), Occupations Code, to deletes existing text providing that the terms of three members of the hearing instrument fitters and dispensers advisory board expire on February 1 of each odd-numbered year.

 

SECTION 12. Amends Section 402.057, Occupations Code, to require the presiding officer to designate a member of the hearing instrument fitters and dispensers advisory board to serve as the presiding officer of the advisory board for a term of two years, rather than one year.

SECTION 16. Amends Section 455.103(a), Occupations Code, to delete existing text providing that the terms of three members of the massage therapy advisory board expire September 1 of each odd-numbered year. 

 

SECTION 17. Amends Section 455.104(a), Occupations Code, to require the presiding officer to designate a member of the advisory board to serve as the presiding officer of the massage therapy advisory board for a term of two-years, rather than one year. 

 

SECTION 18. Amends Section 506.103(a), Occupations Code, to delete existing text providing that members of the behavior analyst advisory board serve staggered six-year terms, with the terms of three members expiring February 1 of each odd-numbered year.

 

SECTION 19. Amends Section 506.104, Occupations Code, to require the presiding officer to designate a member of the advisory board to serve as the presiding officer of the behavior analyst advisory board for a term of two years, rather than a term of one year. 

 

SECTION 20. Amends Section 605.055(a), Occupations Code, to delete existing text providing the terms of two or three members of the orthotists and prosthetists advisory board expire on February 1 of each odd-numbered year. 

 

SECTION 21. Amends Section 605.056, Occupations Code, to require the presiding officer, with TCLR's approval, to designate a member of the orthotists and prosthetists advisory board to serve as the presiding officer of the advisory board for a term of two year, rather than one year.

 

SECTION 22. Amends Section 701.054(a), Occupations Code, to delete existing text providing that the terms of three members of the dietitians advisory board begin on September 1 of each odd-numbered year.

 

SECTION 23. Amends Section 701.057, Occupations Code, to require the presiding officer to designate a member of the dietitians advisory board as the presiding officer of the advisory board to serve for a term of two years, rather than one year.

 

SECTION 24. Amends Section 802.065, Occupations Code, as follows:

SECTION 31. Amends Section 1302.201, Occupations Code, as follows:

Provides that the air conditioning and refrigeration contractors advisory board consists of nine members appointed by the presiding officer, with TCLR's approval, rather than the nine members appointed by the presiding officer, with TCLR's approval, and two ex officio nonvoting members. 

 

SECTION 32. Amends Section 1302.205(a), Occupations Code, to delete existing text providing that the terms of two appointed members of the air conditioning and refrigeration contractors advisory board expire on February 1 of each odd-numbered year. 

 

SECTION 33. Amends Section 1305.052(a), Occupations Code, to provide that advisory board members serve staggered terms of six years, rather than with the terms of three members of the electricians advisory board expiring on February 1 of each odd-numbered year. 

 

SECTION 34. Amends Section 1305.053, Occupations Code, to require the presiding officer to appoint one of the electricians advisory board members to serve as presiding officer of the electricians advisory board for a term of two years, rather than a term of one year.

 

SECTION 35. Amends Section 1603.053(a), Occupations Code, to delete existing text providing that members of the barbering and cosmetology advisory board serve staggered six-year terms, with the terms of three members expiring January 31 of each odd-numbered year. 

 

SECTION 36. Amends Section 1802.102(a), Occupations Code, to provide that the auctioneers advisory board consists of seven members appointed as follows one member who represents an auction school, rather than the administrative head, or the administrative head's designee, of any state agency or office that is selected by TCLR. 

 

SECTION 37. Amends Sections 1802.103 and 1802.104, Occupations Code, as follows:

 

Sec. 1802.103. TERMS; VACANCIES. Provides that auctioneers advisory board members serve staggered six-year terms. Requires the presiding officer, with TCLR's approval, if a vacancy occurs during a member's term, to appoint a replacement to serve for the remainder of the term. Makes a nonsubstantive change.

 

Deletes existing text providing that auctioneers advisory board members serve six-year terms that expire on September 1 of each odd-numbered year. Deletes existing text prohibiting members from serving more than two consecutive terms. Deletes existing text requiring the presiding officer, with TCLR's approval, if a vacancy occurs during the term of such a member, to appoint a replacement to serve for the remainder of the term.

 

Sec. 1802.104. PRESIDING OFFICER. Deletes existing text prohibiting the presiding officer from serving more than two consecutive terms.

SECTION 54. Amends Section 2308.051(a), Occupations Code, to provide the vehicle towing and booting advisory board consists of nine, rather than the following, members appointed by the presiding officer with the approval of TCLR including certain representatives. 

 

SECTION 55. Amends Section 2308.052(a), Occupations Code, to provide that vehicle towing and booting advisory board members serve staggered terms of six years, rather than with the terms of two or three members, as appropriate, expiring on February 1 of each odd-numbered year. 

 

SECTION 56. Amends Section 2308.053, Occupations Code, to require the presiding officer to appoint one of the vehicle towing and booting advisory board members to serve as presiding officer of the advisory board for a term of two years rather than a term of one year.

 

SECTION 57. Amends Section 2309.052(a), Occupations Code, to provide that used automotive parts recyclers advisory board members serve staggered terms of six years, rather than with the terms of one or two members expiring on February 1 of each odd-numbered year. 

 

SECTION 58. Amends Section 2309.053, Occupations Code, to require the presiding officer to appoint one of the used automotive parts recyclers advisory board members to serve as presiding officer of the advisory board for a term of two years, rather than for a term of one year. 

 

SECTION 59. Amends Section 2310.033(a), Occupations Code, to provide that members of the motor fuel metering and quality board serve staggered six-year terms rather than with the terms of three or four members expiring on February 1 of each odd-numbered year. 

 

SECTION 60. Amends Section 2310.034. Occupations Code, to require the presiding officer, with the approval of TCLR to appoint one of the motor fuel metering and quality board members to serve as presiding officer of the board for a term of two years, rather than of one year. 

 

SECTION 61. Amends Sections 662.0037(c) and (e), Transportation Code, as follows:

 

(c) Provides that the motorcycle safety advisory board members serve staggered six-year terms. Deletes existing text providing that the terms of three members expire September 1 of each odd-numbered year. 

 

(e) Requires the presiding officer, on approval of TCLR, to designate a member of the motorcycle safety advisory board to serve as the presiding officer of the advisory board for two years, rather than for a one-year term.

 

SECTION 62. Repealer: Section 506.103(b) (relating to prohibiting a member of the behavior analyst advisory board from serving more than two consecutive six-year terms), Occupations Code.

 

Repealer: Section 605.059 (Meetings), Occupations Code.

 

Repealer: Sections 1302.203 (Ex Officio Members) and 1302.208 (Meetings), Occupations Code. 

 

Repealer: Section 1305.052(b) (relating to prohibiting a member of the electricians advisory board from serving more than two consecutive terms), Occupations Code. 

 

Repealer: Section 1901.106 (Grounds For Removal), Occupations Code. 

 

Repealer: Section 2308.052(b) (relating to prohibiting a member of the vehicle towing and booting from serving more than two full consecutive terms), Occupations Code.
