BILL ANALYSIS Senate Research Center S.B. 2243 89R5546 GP-F By: West Transportation 3/27/2025 As Filed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT S.B. 2243 is one of several bills requested by the Texas Department of Motor Vehicles (TxDMV). In instances when a vehicle, trailer or semi-trailer cannot be positively identified, S.B. 2243 would give TxDMV the authority to require VIN inspections by rule. If approved, this bill would provide another tool to assist TxDMV and law enforcement in identifying stolen vehicles and to prevent fraudulent transactions involving automobiles. As proposed, S.B. 2243 amends current law relating to the authority of the Texas Department of Motor Vehicles to require that a vehicle, trailer, or semitrailer have a vehicle identification number inspection. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Department of Motor Vehicles in SECTION 1 (Section 501.032, Transportation Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 501.032, Transportation Code, by amending Subsection (a) and adding Subsection (a-1), as follows: (a) Requires that a motor vehicle, trailer, or semitrailer have an identification number inspection under Section 501.0321 (Identification Number Inspection) if it meets certain criteria. Deletes existing text requiring that a motor vehicle, trailer, or semitrailer, in addition to any requirement established by Texas Department of Motor Vehicles (TxDMV) rule, have an identification number inspection under Section 501.0321 if it meets certain criteria. (a-1) Requires TxDMV by rule to establish additional categories of motor vehicles, trailers, or semitrailers not specified in Subsection (a) that are required to have vehicle identification number inspections under Section 501.0321. SECTION 2. Amends Section 501.0321(a), Transportation Code, as follows: (a) Requires that an inspection required under Section 501.032 (Identification Number Inspection Required) or a rule adopted under that section verify, as applicable, the identity of certain motor vehicles, trailers, or items. SECTION 3. Effective date: September 1, 2025.
