 A BILL TO BE ENTITLED
 AN ACT
 relating to certain duties regarding county jail prisoners confined
 in out-of-state correctional facilities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Article 49.18, Code of Criminal Procedure, is
 amended by adding Subsection (b-1) to read as follows:
 (b-1)  If a prisoner of a county in this state dies while
 confined in an out-of-state penal institution, the justice of the
 peace of the precinct where the county jail is located shall conduct
 an inquiry into the death and file a written report with the
 attorney general not later than the 30th day after the date on which
 the prisoner died. The justice of the peace shall make a good faith
 effort to obtain all facts relevant to the death and include those
 facts in the report.
 SECTION 2.  Chapter 511, Government Code, is amended by
 adding Section 511.01055 to read as follows:
 Sec. 511.01055.  REPORTS REGARDING PRISONERS CONFINED IN
 OUT-OF-STATE CORRECTIONAL FACILITIES. (a) Not later than February
 1 of each year, each county jail shall submit to the commission a
 report regarding the confinement of prisoners in out-of-state
 correctional facilities during the preceding calendar year. The
 report must include:
 (1)  the total number of prisoners confined in
 out-of-state correctional facilities;
 (2)  the total number of prisoners who died while
 confined in out-of-state correctional facilities; and
 (3)  the total number of prisoners who escaped or
 attempted to escape while confined in out-of-state correctional
 facilities.
 (b)  The commission shall prescribe a form for the report
 required by Subsection (a).
 (c)  Not later than March 1 of each year, the commission
 shall submit a report summarizing the information submitted under
 Subsection (a) for the preceding calendar year to the governor, the
 lieutenant governor, the speaker of the house of representatives,
 and each standing committee of the legislature with primary
 jurisdiction over the commission.
 SECTION 3.  This Act takes effect September 1, 2025.
