 A BILL TO BE ENTITLED
 AN ACT
 relating to memorial markers for certain officers killed in the
 line of duty.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 225.021(c), Transportation Code, is
 amended to read as follows:
 (c)  Except as provided by Section 225.0215, the [The]
 department may not design, construct, or erect a marker under this
 subchapter unless a grant or donation of funds is made to the
 department to cover the cost of the design, construction, and
 erection of the marker.
 SECTION 2.  Subchapter B, Chapter 225, Transportation Code,
 is amended by adding Section 225.0215 to read as follows:
 Sec. 225.0215.  MEMORIAL MARKERS FOR CERTAIN OFFICERS KILLED
 IN LINE OF DUTY. (a)  This section applies only to a marker required
 under this subchapter designating a part of the highway system,
 including a bridge or street, for an individual killed in the line
 of duty who was:
 (1)  a law enforcement officer or peace officer for
 this state or a political subdivision of this state under Article
 2A.001, Code of Criminal Procedure; or
 (2)  a federal law enforcement officer or special agent
 performing duties in this state, including those officers under
 Article 2A.002, Code of Criminal Procedure.
 (b)  Notwithstanding Section 225.021(c), the department may
 design, construct, or erect a marker to which this section applies
 using:
 (1)  money appropriated from the general revenue fund
 to the department for those purposes; and
 (2)  gifts, grants, and donations accepted by the
 department for those purposes.
 SECTION 3.  This Act takes effect September 1, 2025.
