                    BILL ANALYSIS        Senate Research Center   S.B. 311     89R3905 JTZ-F   By: Hughes         State Affairs         3/18/2025         As Filed          AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   S.B. 311 amends Section 22.002(a) of the Texas Government Code to allow the Texas Supreme Court to issue writs of procedendo and certiorari and all writs of quo warranto and mandamus against anyone except the governor.   As proposed, S.B. 311 amends current law relating to the writ power of the Texas Supreme Court.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 22.002(a), Government Code, as follows:   (a) Authorizes the Supreme Court of Texas (supreme court) or a justice of the supreme court to issue writs of procedendo and certiorari and all writs of quo warranto and mandamus agreeable to the principles of law regulating those writs, except the supreme court or justice is prohibited from issuing a writ against the governor.    Deletes existing text authorizing the supreme court or a justice of the supreme court to issue writs of procedendo and certiorari and all writs of quo warranto and mandamus agreeable to the principles of law regulating those writs, against a statutory county court judge, a statutory probate court judge, a district judge, a court of appeals or a justice of a court of appeals, or any officer of state government except the governor, the Texas Court of Criminal Appeals (court of criminal appeals), or a judge of the court of criminal appeals.   SECTION 2. Makes application of Section 22.002(a), Government Code, prospective.   SECTION 3. Effective date: September 1, 2025.

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 311 amends Section 22.002(a) of the Texas Government Code to allow the Texas Supreme Court to issue writs of procedendo and certiorari and all writs of quo warranto and mandamus against anyone except the governor.

 

As proposed, S.B. 311 amends current law relating to the writ power of the Texas Supreme Court.
