No. 417 A BILL TO BE ENTITLED AN ACT relating to the eligibility of certain officers of a political subdivision authorized to impose a tax or issue bonds to hold certain offices concurrently. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 180, Local Government Code, is amended by adding Section 180.0055 to read as follows: Sec. 180.0055. ELIGIBILITY OF CERTAIN ELECTED OR APPOINTED OFFICERS TO HOLD CERTAIN OTHER OFFICES. (a) This section applies only to an elected or appointed office of a political subdivision authorized to impose a tax or issue bonds. This section applies only to the extent it does not conflict with a provision of the state constitution. (b) An officer who holds an office to which this section applies is not eligible to hold at the same time another office to which this section applies. SECTION 2. Not later than the effective date of this Act, an officer who holds more than one office in violation of Section 180.0055, Local Government Code, as added by this Act, shall resign, effective on that date, from each office necessary to allow the officer to be in compliance with the requirement of that section. SECTION 3. This Act takes effect September 1, 2025.
