                    BILL ANALYSIS        Senate Research Center   S.B. 747     89R5695 TSS-D   By: King         Education K-16         4/4/2025         As Filed          AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   In school districts across Texas, students are becoming victims to Child Sexual Abuse Material (CSAM) generated by artificial intelligence (AI) systems. Incidents include students using AI to generate sexually explicit photos of other students and child predators using AI-CSAM to exploit school-aged children.    S.B. 747 seeks to solve this problem by requiring school districts to adopt a policy specifically addressing incidents of bullying that involve the production or distribution of a video or image that depicts, or appears to depict, another student's intimate parts exposed or engaged in sexual conduct. This includes a video or image created through the use of artificial intelligence.    Additionally, the bill clarifies that producing and distributing videos or images that depict, or appear to depict, another student's intimate parts exposed, or another student engaged in sexual conduct, is "cyberbullying." The bill further clarifies that a student may be disciplined for releasing or threatening to release intimate visual materials of a minor created using AI technology. Lastly, the bill directs the school safety center, in consultation with the Office of the Attorney General, to develop a program for use by school districts that addresses the specific risks of producing or distributing sexually explicit visual material created using artificial intelligence technology.    As proposed, S.B. 747 amends current law relating to public school policies and programs regarding the production or distribution of certain intimate visual material by public school students.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 37.0052(b), Education Code, as follows:   (b) Authorizes a student to be removed from class and placed in a disciplinary alternative education program as provided by Section 37.008 (Disciplinary Alternative Education Programs) or expelled if the student engages in or incites certain actions, including releasing or threatening to release intimate visual material of a minor or a student who is 18 years of age or older without the student's consent, including intimate visual material created using artificial intelligence technology.   SECTION 2. Amends Section 37.0832(a), Education Code, by amending Subdivision (2) and adding Subdivision (3) to redefine "cyberbullying" and to define "intimate parts" and "sexual conduct" and to make nonsubstantive changes.   SECTION 3. Amends Section 37.0832(c-1), Education Code, as follows:   (c-1) Requires the Texas Education Agency to adopt minimum standards for a school district's policy under Subsection (c) (relating to the adoption of a policy concerning bullying). Requires that the standards include certain initiatives, including requiring districts to include in the policy provisions specifically addressing incidents of bullying that involve the production or distribution of a video or image that depicts or appears to depict another student with the other student's intimate parts exposed or engaged in sexual conduct, including a video or image created through the use of artificial intelligence technology. Makes nonsubstantive changes.   SECTION 4. Amends Section 37.218(b), Education Code, as follows:   (b) Requires the Texas School Safety Center, in consultation with the Office of the Attorney General, to develop programs for use by school districts that address certain topics related to bullying, including the specific risks of producing or distributing visual material created using artificial intelligence technology that appears to depict a minor engaged in sexual conduct.   SECTION 5. Provides that this Act applies beginning with the 20252026 school year.   SECTION 6. Effective date: upon passage or September 1, 2025.
