Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Keeping America’s Re-4
fineries Act’’. 5

SEC. 2. NO MANDATORY ASSESSMENT OF SAFER TECH-1
NOLOGY AND ALTERNATIVE RISK MANAGE-2
MENT MEASURES REQUIRED WITH RESPECT 3
TO THE USE OF HYDROFLUORIC ACID IN 4
CERTAIN ALKYLATION UNITS. 5
(a) I
NGENERAL.—The owner or operator of a sta-6
tionary source described in subsection (b) of this section 7
shall not be required by the regulations promulgated 8
under section 112(r)(7)(B) of the Clean Air Act (42 9
U.S.C. 7412(r)(7)(B)) to include in any hazard assess-10
ment under clause (ii) of such section 112(r)(7)(B) an as-11
sessment of safer technology and alternative risk manage-12
ment measures with respect to the use of hydrofluoric acid 13
in an alkylation unit. 14
(b) S
TATIONARYSOURCEDESCRIBED.—A stationary 15
source described in this subsection is a stationary source 16
(as defined in section 112(r)(2)(C) of the Clean Air Act 17
(42 U.S.C. 7412(r)(2)(C)) in North American Industry 18
Classification System code 324— 19
(1) for which a construction permit or operating 20
permit has been issued pursuant to the Clean Air 21
Act (42 U.S.C. 7401 et seq.); or 22
(2) for which the owner or operator dem-23
onstrates to the Administrator of the Environmental 24
Protection Agency that such stationary source con-25
forms or will conform to the most recent version of 26
