Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Keeping America’s Re-4
fineries Act’’. 5
SEC. 2. NO MANDATORY ASSESSMENT OF SAFER TECH-6
NOLOGY AND ALTERNATIVE RISK MANAGE-7
MENT MEASURES REQUIRED WITH RESPECT 8
TO THE USE OF HYDROFLUORIC ACID IN 9
CERTAIN ALKYLATION UNITS. 10
(a) I
NGENERAL.—The owner or operator of a sta-11
tionary source described in subsection (b) of this section 12
shall not be required by the regulations promulgated 13
under section 112(r)(7)(B) of the Clean Air Act (42 14
U.S.C. 7412(r)(7)(B)) to include in any hazard assess-15
ment under clause (ii) of such section 112(r)(7)(B) an as-16
sessment of safer technology and alternative risk manage-17
ment measures with respect to the use of hydrofluoric acid 18
in an alkylation unit. 19
(b) S
TATIONARYSOURCEDESCRIBED.—A stationary 20
source described in this subsection is a stationary source 21
(as defined in section 112(r)(2)(C) of the Clean Air Act 22
(42 U.S.C. 7412(r)(2)(C)) in North American Industry 23
Classification System code 324— 24

permit has been issued pursuant to the Clean Air 2
Act (42 U.S.C. 7401 et seq.); or 3

forms or will conform to the most recent version of 7
American Petroleum Institute Recommended Prac-8
tice 751. 9
