Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Pueblo Economic 4 Transfer Act’’. 5 SEC. 2. CLOSURE AND DISPOSAL OF THE PUEBLO CHEM-6 ICAL DEPOT, PUEBLO COUNTY, COLORADO. 7 (a) I NGENERAL.—The Secretary of the Army shall 8 close Pueblo Chemical Depot in Pueblo County, Colorado 9 (in this section referred to as the ‘‘Depot’’), not later than 10 VerDate Sep 11 2014 07:30 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2746.IH H2746 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 2746 IH one year after the completion of the chemical demilitariza-1 tion mission in such location in accordance with the Chem-2 ical Weapons Convention Treaty. 3 (b) P ROCEDURES.—The Secretary of the Army shall 4 carry out the closure and subsequent related property 5 management and disposal of the Depot, including the 6 land, buildings, structures, infrastructure, and associated 7 equipment, installed equipment, material, and personal 8 property that comprise the Chemical Agent-Destruction 9 Pilot Plant, in accordance with the procedures and au-10 thorities for the closure, management, and disposal of 11 property under the Defense Base Closure and Realign-12 ment Act of 1990, as amended (part A of title XXIX of 13 Public Law 101–510; 10 U.S.C. 2687 note). 14 (c) O FFICE OFLOCALDEFENSECOMMUNITYCO-15 OPERATIONACTIVITIES.—The Office of Local Defense 16 Community Cooperation of the Department of Defense 17 may make grants and supplement other Federal funds 18 pursuant to section 2391 of title 10, United States Code, 19 to support closure and reuse activities of the Depot. 20 (d) T REATMENT OFEXISTINGPERMITS.—Nothing in 21 this section shall be construed to prevent the removal or 22 demolition by the Program Executive Office, Assembled 23 Chemical Weapons Alternatives of the Department of the 24 Army of existing buildings, structures, infrastructure, and 25 VerDate Sep 11 2014 07:30 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2746.IH H2746 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2746 IH associated equipment, installed equipment, material, and 1 personal property of the Chemical Agent-Destruction Pilot 2 Plant at the Depot in accordance with the existing Haz-3 ardous Waste Permit Number CO–20–09–02–01 under 4 the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.) 5 (commonly known as the Resource Conservation and Re-6 covery Act of 1976) issued by the State of Colorado, or 7 any associated or follow-on permits under such Act. 8 (e) H OMELESSUSE.—Given the nature of activities 9 undertaken at the Chemical Agent-Destruction Pilot Plant 10 at the Depot, such land, buildings, structures, infrastruc-11 ture, and associated equipment, installed equipment, ma-12 terial, and personal property comprising the Chemical 13 Agent-Destruction Pilot Plant is deemed unsuitable for 14 homeless use, and in carrying out any closure, manage-15 ment, or disposal of property under this section, need not 16 be screened for homeless use purposes pursuant to Section 17 2905(b)(7) of the Defense Base Closure and Realignment 18 Act of 1990, as amended (part A of title XXIX of Public 19 Law 101–510; 10 U.S.C. 2687 note). 20 Æ VerDate Sep 11 2014 07:30 Apr 26, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2746.IH H2746 kjohnson on DSK79L0C42PROD with BILLS
