In the Senate of the United States, May 9, 2023. Resolved, That the bill from the House of Representa- tives (H.R. 346) entitled ‘‘An Act to establish a task force on improvements for notices to air missions, and for other purposes.’’, do pass with the following AMENDMENT: Strike all after the enacting clause and insert the following: SECTION 1. SHORT TITLE. 1 This Act may be cited as the ‘‘NOTAM Improvement 2 Act of 2023’’. 3 SEC. 2. FAA TASK FORCE ON NOTAM IMPROVEMENT. 4 (a) E STABLISHMENT.—Not later than 180 days after 5 the date of enactment of this Act, the Administrator of the 6 Federal Aviation Administration shall establish a task force 7 to be known as the FAA Task Force on NOTAM Improve-8 ment (in this section referred to as the ‘‘Task Force’’). 9 2 †HR 346 EAS (b) COMPOSITION.—The Task Force shall consist of 1 members appointed by the Administrator, including at least 2 one member of each of the following: 3 (1) Air carrier representatives. 4 (2) Airport representatives. 5 (3) Labor union representatives of airline pilots. 6 (4) Labor union representatives of aircraft dis-7 patchers. 8 (5) The labor union certified under section 7111 9 of title 5, United States Code, to represent FAA air 10 traffic control specialists assigned to the United 11 States NOTAMs Office. 12 (6) The labor union certified under section 7111 13 of title 5, United States Code, to represent FAA aero-14 nautical information specialists. 15 (7) General and business aviation representa-16 tives. 17 (8) Aviation safety experts with knowledge of 18 NOTAMs. 19 (9) Human factors experts. 20 (10) Computer system architecture and cyberse-21 curity experts. 22 (c) D UTIES.—The duties of the Task Force shall in-23 clude— 24 3 †HR 346 EAS (1) reviewing existing methods for publishing 1 NOTAMs and flight operations information to pilots; 2 (2) reviewing regulations, policies, systems, and 3 international standards relating to NOTAMs, includ-4 ing their content and presentation to pilots; 5 (3) evaluating and determining best practices to 6 organize, prioritize, and present flight operations in-7 formation in a manner that optimizes pilot review 8 and retention of relevant information; and 9 (4) providing recommendations for— 10 (A) improving the publication and delivery 11 of NOTAM information in a manner that 12 prioritizes or highlights the most important in-13 formation, and optimizes pilot review and reten-14 tion of relevant information; 15 (B) ways to ensure that NOTAMs are com-16 plete, accurate, timely, relevant to safe flight op-17 erations, and contain pertinent information; 18 (C) any best practices that the FAA should 19 consider to improve the accuracy and under-20 standability of NOTAMs and the display of 21 flight operations information; 22 (D) ways to work with air carriers, other 23 airspace users, and aviation service providers to 24 4 †HR 346 EAS implement solutions that are aligned with the 1 recommendations under this paragraph; and 2 (E) ways to ensure the stability, resiliency, 3 and cybersecurity of the NOTAM computer sys-4 tem. 5 (d) R EPORT.—Not later than 1 year after the date of 6 the establishment of the Task Force, the Task Force shall 7 submit to the Committee on Transportation and Infrastruc-8 ture of the House of Representatives and the Committee on 9 Commerce, Science, and Transportation of the Senate a re-10 port detailing— 11 (1) the results of the reviews and evaluations of 12 the Task Force under paragraphs (1) through (3) of 13 subsection (c); 14 (2) the best practices identified and rec-15 ommendations provided by the Task Force under sub-16 section (c)(4); 17 (3) any recommendations of the Task Force for 18 additional regulatory or policy actions to improve the 19 publication of NOTAMs; and 20 (4) the degree to which implementing the rec-21 ommendations of the Task Force described under 22 paragraph (2) will address National Transportation 23 Safety Board Safety Recommendation A–18–024. 24 5 †HR 346 EAS (e) APPLICABLELAW.—Chapter 10 of title 5, United 1 States Code, shall not apply to the Task Force. 2 (f) S UNSET.—The Task Force shall terminate on the 3 later of— 4 (1) the date on which the Task Force submits the 5 report required under subsection (d); or 6 (2) the date that is 18 months after the date on 7 which the Task Force is established under subsection 8 (a). 9 (g) A UTHORITY.—The Administrator shall have the 10 authority to carry out the recommendations of the Task 11 Force detailed in the report required under subsection (d). 12 (h) R ULE OFCONSTRUCTION.—Nothing in this section 13 may be construed to require the FAA to duplicate any 14 prior, ongoing, or planned efforts related to the improve-15 ment of NOTAMs, including any efforts related to imple-16 menting any previously enacted requirements. 17 (i) D EFINITIONS.—In this section: 18 (1) FAA.—The term ‘‘FAA’’ means the Federal 19 Aviation Administration. 20 (2) NOTAM.—The term ‘‘NOTAM’’ means a no-21 tice containing information (which is not known suf-22 ficiently in advance to publicize by other means) con-23 cerning the establishment, condition, or change in 24 any component (including a facility, service, or pro-25 6 †HR 346 EAS cedure thereof) or hazard in the National Airspace 1 System, the timely knowledge of which is essential to 2 personnel concerned with flight operations. 3 SEC. 3. ADDITIONAL REQUIREMENTS. 4 Not later than September 30, 2024, the Administrator 5 of the Federal Aviation Administration shall make the fol-6 lowing improvements: 7 (1) Complete implementation of a Federal 8 NOTAM System (in this section referred to as a 9 ‘‘FNS’’). 10 (2) Implement a back-up system to the FNS. 11 (3) Brief the Committee on Transportation and 12 Infrastructure of the House of Representatives and the 13 Committee on Commerce, Science, and Transpor-14 tation of the Senate on a plan to enhance the capa-15 bility to deliver information through the FNS that is 16 machine-readable, filterable, and in the format used 17 by the International Civil Aviation Organization 18 (ICAO) to promote further global harmonization 19 among neighboring Air Navigation Service Providers 20 (ANSPs) and provide users of the National Airspace 21 7 †HR 346 EAS System with one consistent format for domestic and 1 international operations. 2 Attest: Secretary. 118 TH CONGRESS 1 ST S ESSION H.R. 346 AMENDMENT
