Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Fort San Gero´nimo 4
Preservation Act’’. 5
SEC. 2. DEFINITIONS. 6
In this Act: 7
(1) F
ORT SAN GERO´NIMO DEL BOQUERO ´N.— 8
The term ‘‘Fort San Gero´nimo del Boquero´n’’ (also 9
known as ‘‘Fortı´n de San Gero´nimo del Boquero´n’’) 10
means the fort and grounds listed on the National 11
Register of Historic Places and located near Old San 12
Juan, Puerto Rico. 13
(2) S
ECRETARY.—The term ‘‘Secretary’’ means 14
the Secretary of the Interior. 15
SEC. 3. ESTABLISHMENT OF AFFILIATED AREA. 16
(a) I
NGENERAL.—Fort San Gero´nimo del Boquero´n 17
in Puerto Rico is established as an affiliated area of the 18
National Park System. 19
(b) D
ESCRIPTION OFAFFILIATEDAREA.—The affili-20
ated area shall consist of the area generally depicted on 21
the map titled ‘‘Fort San Gero´nimo Proposed Affiliated 22
Area’’, numbered 910/176698, and dated July 2021. 23
(c) A
DMINISTRATION.—The affiliated area shall be 24
managed in accordance with— 25

(1) this Act; and 1
(2) any law generally applicable to units of the 2
National Park System. 3
(d) M
ANAGEMENTENTITY.—The Institute of Puerto 4
Rican Culture shall be the management entity for the af-5
filiated area. 6
(e) C
OOPERATIVE AGREEMENTS.—The Secretary 7
may provide technical assistance and enter into coopera-8
tive agreements with the management entity for the pur-9
pose of providing financial assistance for the marketing, 10
marking, interpretation, and preservation of the affiliated 11
area. 12
(f) L
IMITEDROLE OF THESECRETARY.—Nothing in 13
this section authorizes the Secretary to acquire property 14
at the affiliated area or to assume managerial or financial 15
responsibility for the operation, maintenance, or manage-16
ment of the affiliated area. 17
(g) M
ANAGEMENTPLAN.— 18
(1) I
N GENERAL.—The Secretary, in consulta-19
tion with the management entity, shall develop a 20
management plan for the affiliated area. 21
(2) T
RANSMITTAL.—Not later than 3 years 22
after the date on which funds are first made avail-23
able to carry out this section, the Secretary shall 24
submit the management plan developed under para-25

RIVATEPROPERTYPROTECTION.—Nothing in 4
this Act affects the land use rights of private property 5
owners adjacent to Fort San Gero´nimo del Boquero´n. 6
(i) N
OBUFFERZONES.— 7
(1) I
N GENERAL.—Nothing in this Act shall be 8
construed to create buffer zones outside of Fort San 9
Gero´nimo del Boquero´n. 10
(2) A
CTIVITY OR USE OUTSIDE FORT SAN 11
GERO´NIMO DEL BOQUERO´N.—The fact that an activ-12
ity or use can be seen, heard, or detected from with-13
in Fort San Gero´nimo del Boquero´n shall not pre-14
clude, limit, control, regulate, or determine the con-15
duct or management of activities or uses outside of 16
Fort San Gero´nimo del Boquero´n. 17
