AN ACT
To establish Fort San Gero´nimo del Boquero´n in Puerto
Rico as an affiliated area of the National Park System,
and for other purposes.
Be it enacted by the Senate and House of Representa-1

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Fort San Gero´nimo 2
Preservation Act’’. 3
SEC. 2. DEFINITIONS. 4
In this Act: 5
(1) F
ORT SAN GERO´NIMO DEL BOQUERO ´N.— 6
The term ‘‘Fort San Gero´nimo del Boquero´n’’ (also 7
known as ‘‘Fortı´n de San Gero´nimo del Boquero´n’’) 8
means the fort and grounds listed on the National 9
Register of Historic Places and located near Old San 10
Juan, Puerto Rico. 11
(2) S
ECRETARY.—The term ‘‘Secretary’’ means 12
the Secretary of the Interior. 13
SEC. 3. ESTABLISHMENT OF AFFILIATED AREA. 14
(a) I
NGENERAL.—Fort San Gero´nimo del Boquero´n 15
in Puerto Rico is established as an affiliated area of the 16
National Park System. 17
(b) D
ESCRIPTION OFAFFILIATEDAREA.—The affili-18
ated area shall consist of the area generally depicted on 19
the map titled ‘‘Fort San Gero´nimo Proposed Affiliated 20
Area’’, numbered 910/176698, and dated July 2021. 21
(c) A
DMINISTRATION.—The affiliated area shall be 22
managed in accordance with— 23
(1) this Act; and 24
(2) any law generally applicable to units of the 25
National Park System. 26 3

(d) MANAGEMENTENTITY.—The Institute of Puerto 1
Rican Culture shall be the management entity for the af-2
filiated area. 3
(e) C
OOPERATIVE AGREEMENTS.—The Secretary 4
may provide technical assistance and enter into coopera-5
tive agreements with the management entity for the pur-6
pose of providing financial assistance for the marketing, 7
marking, interpretation, and preservation of the affiliated 8
area. 9
(f) L
IMITEDROLE OF THESECRETARY.—Nothing in 10
this section authorizes the Secretary to acquire property 11
at the affiliated area or to assume managerial or financial 12
responsibility for the operation, maintenance, or manage-13
ment of the affiliated area. 14

ANAGEMENTPLAN.— 15
(1) I
N GENERAL.—The Secretary, in consulta-16
tion with the management entity, shall develop a 17
management plan for the affiliated area. 18
(2) T
RANSMITTAL.—Not later than 3 years 19
after the date on which funds are first made avail-20
able to carry out this section, the Secretary shall 21
submit the management plan developed under para-22
graph (1) to the Committee on Natural Resources of 23
the House of Representatives and the Committee on 24
Energy and Natural Resources of the Senate. 25 4

(h) PRIVATEPROPERTYPROTECTION.—Nothing in 1
this Act affects the land use rights of private property 2
owners adjacent to Fort San Gero´nimo del Boquero´n. 3

OBUFFERZONES.— 4
(1) I
N GENERAL.—Nothing in this Act shall be 5
construed to create buffer zones outside of Fort San 6
Gero´nimo del Boquero´n. 7
(2) A
CTIVITY OR USE OUTSIDE FORT SAN 8
GERO´NIMO DEL BOQUERO´N.—The fact that an activ-9
ity or use can be seen, heard, or detected from with-10
in Fort San Gero´nimo del Boquero´n shall not pre-11
clude, limit, control, regulate, or determine the con-12
duct or management of activities or uses outside of 13
Fort San Gero´nimo del Boquero´n. 14
