Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Stop Harboring Ira-4 nian Petroleum Act’’ or the ‘‘SHIP Act’’. 5 SEC. 2. STATEMENT OF POLICY. 6 It is the policy of the United States— 7 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3774 IH (1) to deny Iran the ability to engage in desta-1 bilizing activities, support international terrorism, 2 fund the development and acquisition of weapons of 3 mass destruction, and the means to deliver them by 4 limiting Iran’s export of petroleum and petroleum 5 products; 6 (2) to deny Iran funds to oppress and commit 7 human rights violations against the Iranian people 8 assembling to peacefully redress the Iranian regime; 9 (3) to sanction those entities who violate United 10 States law by providing support to the Iranian en-11 ergy sector; and 12 (4) that Iran’s actions to finance and facilitate 13 the participation of foreign terrorist organizations in 14 ongoing conflicts and illicit activities is detrimental 15 to the security interests of the United States. 16 SEC. 3. IMPOSITION OF SANCTIONS WITH RESPECT TO IRA-17 NIAN PETROLEUM. 18 (a) I NGENERAL.—On and after the date that is 90 19 days after the date of the enactment of this Act, and ex-20 cept as provided in subsection (e)(2), the President shall 21 impose the sanctions described in subsection (c) with re-22 spect to each foreign person that the President deter-23 mines, on or after such date of enactment, engages in an 24 activity described in subsection (b). 25 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3774 IH (b) ACTIVITIESDESCRIBED.—A foreign person en-1 gages in an activity described in this paragraph if the for-2 eign person— 3 (1) knowingly owns or operates a foreign port 4 where at least 1 designated vessel has landed on or 5 after the date of enactment of this Act at such port 6 for the purpose of transporting Iranian crude oil; 7 (2) knowingly transports, offloads, or otherwise 8 deals in petroleum or petroleum products, including 9 petrochemicals, originating from Iran; 10 (3) knowingly owns or operates a vessel used to 11 conduct ship-to-ship transfers of petroleum or petro-12 leum products originating from Iran; 13 (4) owns or operates a refinery that knowingly 14 processes, refines, or otherwise deals in petroleum or 15 petroleum products originating from Iran; 16 (5) is an adult family member of a foreign per-17 son described in any of paragraphs (1) through (4); 18 (6) is owned or controlled by a foreign person 19 described in any of paragraphs (1) through (5); or 20 (7) knowingly engages in a significant trans-21 action with, or provides material support to or for, 22 a foreign person described in any of paragraphs (1) 23 through (6). 24 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3774 IH (c) SANCTIONSDESCRIBED.—The sanctions de-1 scribed in this subsection with respect to a foreign person 2 described in subsection (a) are the following: 3 (1) B LOCKING OF PROPERTY .—The President 4 shall exercise all of the powers granted to the Presi-5 dent under the International Emergency Economic 6 Powers Act (50 U.S.C. 1701 et seq.) to the extent 7 necessary to block and prohibit all transactions in 8 property and interests in property of the foreign per-9 son if such property and interests in property are in 10 the United States, come within the United States, or 11 are or come within the possession or control of a 12 United States person. 13 (2) I NELIGIBILITY FOR VISAS, ADMISSION, OR 14 PAROLE.— 15 (A) V ISAS, ADMISSION, OR PAROLE.—An 16 alien described in subsection (a) is— 17 (i) inadmissible to the United States; 18 (ii) ineligible to receive a visa or other 19 documentation to enter the United States; 20 and 21 (iii) otherwise ineligible to be admitted 22 or paroled into the United States or to re-23 ceive any other benefit under the Immigra-24 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3774 IH tion and Nationality Act (8 U.S.C. 1101 et 1 seq.). 2 (B) C URRENT VISAS REVOKED .— 3 (i) I N GENERAL.—An alien described 4 in subsection (a) is subject to revocation of 5 any visa or other entry documentation re-6 gardless of when the visa or other entry 7 documentation is or was issued. 8 (ii) I MMEDIATE EFFECT .—A revoca-9 tion under clause (i) shall take effect im-10 mediately and automatically cancel any 11 other valid visa or entry documentation 12 that is in the alien’s possession. 13 (C) E XCEPTIONS.—Sanctions under this 14 paragraph shall not apply with respect to an 15 alien if admitting or paroling the alien into the 16 United States is necessary— 17 (i) to permit the United States to 18 comply with the Agreement regarding the 19 Headquarters of the United Nations, 20 signed at Lake Success June 26, 1947, 21 and entered into force November 21, 1947, 22 between the United Nations and the 23 United States, or other applicable inter-24 national obligations; or 25 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 3774 IH (ii) to carry out or assist law enforce-1 ment activity in the United States. 2 (3) P ENALTIES.—The penalties provided for in 3 subsections (b) and (c) of section 206 of the Inter-4 national Emergency Economic Powers Act (50 5 U.S.C. 1705) shall apply to a person that violates, 6 attempts to violate, conspires to violate, or causes a 7 violation of this section or any regulations promul-8 gated to carry out this section to the same extent 9 that such penalties apply to a person that commits 10 an unlawful act described in section 206(a) of that 11 Act. 12 (d) I MPLEMENTATION; REGULATIONS.— 13 (1) I N GENERAL.—The President may exercise 14 all authorities under sections 203 and 205 of the 15 International Emergency Economic Powers Act (50 16 U.S.C. 1702 and 1704) for purposes of carrying out 17 this section. 18 (2) D EADLINE FOR REGULATIONS .—Not later 19 than 180 days after the date of the enactment of 20 this Act, the President shall prescribe such regula-21 tions as may be necessary for the implementation of 22 this Act. 23 (3) N OTIFICATION TO CONGRESS .—Not later 24 than 10 days before the prescription of regulations 25 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 3774 IH under paragraph (2), the President shall brief and 1 provide written notification to the appropriate con-2 gressional committees regarding— 3 (A) the proposed regulations; and 4 (B) the specific provisions of this Act that 5 the regulations are implementing. 6 (e) W AIVER.— 7 (1) I N GENERAL.—The President may, on a 8 case-by-case basis and for periods not to exceed 180 9 days each, waive the application of sanctions im-10 posed with respect to a foreign person under this 11 section if the President certifies to the appropriate 12 congressional committees, not later than 15 days be-13 fore such waiver is to take effect, that the waiver is 14 vital to the national security interests of the United 15 States. 16 (2) S PECIAL RULE.—The President shall not be 17 required to impose sanctions under this section with 18 respect to a foreign person described in subsection 19 (a) if the President certifies in writing to the appro-20 priate congressional committees that the foreign per-21 son— 22 (A) is no longer engaging in activities de-23 scribed in subsection (b); or 24 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 3774 IH (B) has taken and is continuing to take 1 significant, verifiable steps toward permanently 2 terminating such activities. 3 (f) T ERMINATION.—The authorities provided by this 4 section shall cease to have effect on and after the date 5 that is 30 days after the date on which the President cer-6 tifies to the appropriate congressional committees that— 7 (1) the Government of Iran no longer repeat-8 edly provides support for international terrorism as 9 determined by the Secretary of State pursuant to— 10 (A) section 1754(c)(1)(A) of the Export 11 Control Reform Act of 2018 (50 U.S.C. 12 4318(c)(1)(A)); 13 (B) section 620A of the Foreign Assistance 14 Act of 1961 (22 U.S.C. 2371); 15 (C) section 40 of the Arms Export Control 16 Act (22 U.S.C. 2780); or 17 (D) any other provision of law; and 18 (2) Iran has ceased the pursuit, acquisition, 19 and development of, and verifiably dismantled, its 20 nuclear, biological, and chemical weapons, ballistic 21 missiles, and ballistic missile launch technology. 22 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 9 •HR 3774 IH SEC. 4. REPORT ON IRANIAN PETROLEUM AND PETRO-1 LEUM PRODUCTS EXPORTS. 2 (a) I NGENERAL.—Not later than 120 days after the 3 date of enactment of this Act, and annually thereafter 4 until the date described in subsection (d), the Adminis-5 trator of the Energy Information Administration shall 6 submit to the appropriate congressional committees a re-7 port describing Iran’s growing exports of petroleum and 8 petroleum products, that includes the following: 9 (1) An analysis of Iran’s exports and sale of pe-10 troleum and petroleum products, including— 11 (A) an estimate of Iran’s petroleum export 12 and sale revenue per year since 2018; 13 (B) an estimate of Iran’s petroleum export 14 and sale revenue to China per year since 2018; 15 (C) the amount of petroleum and crude oil 16 barrels exported per year since 2018; 17 (D) the amount of petroleum and crude oil 18 barrels exported to China per year since 2018; 19 (E) the amount of petroleum and crude oil 20 barrels exported to countries other than China 21 per year since 2018; 22 (F) the average price per petroleum and 23 crude oil barrel exported per year since 2018; 24 and 25 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 10 •HR 3774 IH (G) the average price per petroleum and 1 crude oil barrel exported to China per year 2 since 2018. 3 (2) An analysis of Iran’s labeling practices of 4 exported petroleum and petroleum products. 5 (3) A description of companies involved in the 6 exporting and sale of Iranian petroleum and petro-7 leum products. 8 (4) A description of ships involved in the ex-9 porting and sale of Iranian petroleum and petroleum 10 products. 11 (5) A description of ports involved in the ex-12 porting and sale of Iranian petroleum and petroleum 13 products. 14 (b) F ORM.—The report required by subsection (a) 15 shall be submitted in unclassified form but may include 16 a classified annex. 17 (c) P UBLICATION.—The unclassified portion of the 18 report required by subsection (a) shall be posted on a pub-19 licly available website of the Energy Information Adminis-20 tration. 21 (d) T ERMINATION.—The requirement to submit re-22 ports under this section shall be terminated on the date 23 on which the President makes the certification described 24 in section 3(f). 25 VerDate Sep 11 2014 02:06 Jun 21, 2023 Jkt 039200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H3774.IH H3774 kjohnson on DSK79L0C42PROD with BILLS 11 •HR 3774 IH SEC. 5.
