UNIFORMITY OF PESTICIDE LABELING REQUIRE-1 MENTS. 2 (a) I NGENERAL.—Section 24(b) of the Federal In-3 secticide, Fungicide, and Rodenticide Act (7 U.S.C. 4 136v(b)) shall be applied to require uniformity in national 5 pesticide labeling, and prohibit any State, instrumentality 6 or political subdivision thereof, or a court from directly 7 or indirectly imposing or continuing in effect any require-8 ments for, or penalize or hold liable any entity for failing 9 to comply with requirements with respect to, labeling or 10 packaging that is in addition to or different from the label-11 ing or packaging approved by the Administrator under 12 such Act (7 U.S.C. et seq.), including any requirements 13 relating to warnings on such labeling or packaging. 14 (b) P ROHIBITION.—The Administrator may not issue 15 or adopt any guidance or any policy, take any regulatory 16 action, or approve any labeling (or change to such label-17 ing) that is inconsistent with or in any respect different 18 from the conclusion of— 19 (1) a human health assessment performed pur-20 suant to the Federal Insecticide, Fungicide, and 21 Rodenticide Act (7 U.S.C. 136 et seq.); or 22 (2) a carcinogenicity classification for a pes-23 ticide performed pursuant to such Act (7 U.S.C. 136 24 et seq.). 25 Æ VerDate Sep 11 2014 16:09 Jul 30, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H4288.IH H4288 pbinns on DSKJLVW7X2PROD with $$_JOB
