AN ACT
To prohibit the use of Federal funds to provide housing
to specified aliens on any land under the administrative
jurisdiction of the Federal land management agencies.
Be it enacted by the Senate and House of Representa-1

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Protecting our Com-2
munities from Failure to Secure the Border Act of 2023’’. 3
SEC. 2. PROHIBITION ON PROVIDING HOUSING TO SPECI-4
FIED ALIENS. 5
(a) I
NGENERAL.—No Federal funds may be used 6
to provide housing to specified aliens on any land under 7
the administrative jurisdiction of the Federal land man-8
agement agencies, including through leases, contracts, or 9
agreements. 10
(b) R
EVOCATION OFLEASE.—The lease between the 11
United States of America/United States Department of 12
the Interior/National Park Service and the City of New 13
York for the Premises known as Portions of Floyd Ben-14
nett Field, in the Jamaica Bay Unit of Gateway National 15
Recreation Area (NPS Lease# L–GATE912–2023, Com-16
mencement Date - September 15, 2023) is hereby revoked. 17

EFINITIONS.—In this section: 18
(1) F
EDERAL LAND MANAGEMENT AGENCIES .— 19
The term ‘‘Federal land management agencies’’ 20
means the National Park Service, the Bureau of 21
Land Management, the United States Fish and 22
Wildlife Service, and the Forest Service. 23
(2) H
OUSING.—The term ‘‘housing’’ means a 24
temporary or permanent encampment used for the 25
primary purpose of sheltering specified aliens. 26 3

(3) SPECIFIED ALIEN.—The term ‘‘specified 1
alien’’ means an alien who has not been admitted, 2
as such terms are defined in section 101(a) of the 3
Immigration and Nationality Act (8 U.S.C. 4
1101(a)). 5
SEC. 3. REPORT. 6
(a) I
NGENERAL.—The Secretary of the Interior and 7
the Secretary of Agriculture shall jointly submit to the ap-8
propriate congressional committees an annual report that 9
includes— 10
(1) the number of specified aliens that have 11
been provided housing on any land under the admin-12
istrative jurisdiction of the Federal land manage-13
ment agencies; and 14
(2) information regarding the countries of ori-15
gin of such specified aliens. 16
(b) D
EFINITION.—In this section, the term ‘‘appro-17
priate congressional committees’’ means— 18
(1) the Committee on Natural Resources and 19
the Committee on Agriculture of the House of Rep-20
resentatives; and 21 4

(2) the Committee on Energy and Natural Re-1
sources and the Committee on Agriculture, Nutri-2
tion, and Forestry of the Senate. 3
