A BILL
To amend the Indian Self-Determination and Education As-
sistance Act to allow the Secretary of Agriculture to
enter into self-determination contracts with Indian Tribes
and Tribal organizations to carry out supplemental nutri-
tion assistance programs.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘SNAP Tribal Food 4
Sovereignty Act of 2023’’. 5

SEC. 2. SELF-DETERMINATION FOR SNAP. 1
Title I of the Indian Self-Determination and Edu-2
cation Assistance Act (25 U.S.C. 5321 et seq.) is amended 3
by adding at the end the following: 4
‘‘SEC. 112. SELF-DETERMINATION FOR SNAP. 5
‘‘(a) A
GRICULTURESELF-DETERMINATIONAUTHOR-6
IZED.—The Secretary of Agriculture shall enter into self- 7
determination contracts, in accordance with subsection 8
(b), with Indian Tribes and Tribal organizations, on the 9
request of any Indian Tribe by Tribal resolution, to plan, 10
conduct, and administer any function, service, or activity 11
of the supplemental nutrition assistance program estab-12
lished under the Food and Nutrition Act of 2008 (7 13
U.S.C. 2011 et seq.) for the Indian Tribe. 14
‘‘(b) S
ELF-DETERMINATIONCONTRACT.—A self-de-15
termination contract entered into under subsection (a) 16
shall have the same terms and conditions, and be subject 17
to the same procedures, regulations, and requirements, as 18
a self-determination contract entered into under section 19
102, except that the Secretary of Agriculture and the De-20
partment of Agriculture shall be the appropriate Secretary 21
and agency for purposes of a self-determination contract 22
entered into under subsection (a). 23
‘‘(c) T
ECHNICALASSISTANCE.—The Office of Self- 24
Governance of the Bureau of Indian Affairs shall provide 25

technical assistance regarding the self-determination con-1
tracts authorized under this section to— 2
‘‘(1) the Secretary of Agriculture; and 3
‘‘(2) Indian Tribes and Tribal organizations 4
that request that assistance.’’. 5
SEC. 3. SELF-GOVERNANCE FOR SNAP. 6
Title IV of the Indian Self-Determination and Edu-7
cation Assistance Act (25 U.S.C. 5361 et seq.) is amended 8
by adding at the end the following: 9
‘‘SEC. 418. SELF-GOVERNANCE FOR SNAP. 10
‘‘(a) A
GRICULTURE SELF-GOVERNANCE AUTHOR-11
IZED.—The Secretary of Agriculture shall enter into self- 12
governance compacts and funding agreements, in accord-13
ance with subsection (b), with Indian Tribes and Tribal 14
organizations, on the request of any Indian Tribe by Trib-15
al resolution, to plan, conduct, and administer any func-16
tion, service, or activity of the supplemental nutrition as-17
sistance program established under the Food and Nutri-18
tion Act of 2008 (7 U.S.C. 2011 et seq.) for the Indian 19
Tribe. 20
‘‘(b) S
ELF-GOVERNANCECOMPACT AND FUNDING 21
A
GREEMENT.—A self-governance compact and funding 22
agreement entered into under subsection (a) shall have the 23
same terms and conditions, and be subject to the same 24
procedures, regulations, and requirements, as a self-gov-25

ernance compact and funding agreement entered into 1
under sections 40 and 403, except that the Secretary of 2
Agriculture and the Department of Agriculture shall be 3
the appropriate Secretary and agency for purposes of a 4
self-governance compact and funding agreement under 5
this section. 6
‘‘(c) T
ECHNICALASSISTANCE.—The Office of Self- 7
Governance of the Department of the Interior shall pro-8
vide technical assistance regarding the self-governance 9
compacts and funding agreements authorized under this 10
section to— 11
‘‘(1) the Secretary of Agriculture; and 12
‘‘(2) Indian Tribes and Tribal organizations 13
that request that assistance.’’. 14
