To provide supplemental appropriations for fiscal year 2024, 
and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
That following sums are appropriated, out of any money 3
in the Treasury not otherwise appropriated, for the fiscal 4
year ending September 30, 2024, and for other purposes, 5

$976,405,000 shall be to respond to the situation in 2
Ukraine and for related expenses: Provided further, That 3
of the total amount provided under this heading in this 4
Act, $557,758,000, to remain available until September 5
30, 2024, shall be to support improvements to the sub-6
marine industrial base and for related expenses: Provided 7
further, That such amount is designated by the Congress 8
as being for an emergency requirement pursuant to sec-9
tion 251(b)(2)(A)(i) of the Balanced Budget and Emer-10
gency Deficit Control Act of 1985. 11

ations in Ukraine, and Taiwan and for related expenses: 20
Provided, That of the total amount provided under this 21
heading in this Act, $13,772,460,000, to remain available 22
until September 30, 2025, shall be for the Ukraine Secu-23
rity Assistance Initiative: Provided further, That such 24
funds for the Ukraine Security Assistance Initiative shall 25

be available to the Secretary of Defense under the same 1
terms and conditions as are provided for under this head-2
ing in the Additional Ukraine Supplemental Appropria-3
tions Act, 2023 (division M of Public Law 117–12 328), 4
and shall be available notwithstanding section 8135 of the 5
Department of Defense Appropriations Act, 2023 (division 6
C of Public Law 117–328) or any similar provision in any 7
other Act making appropriations for the Department of 8
Defense: Provided further, That up to $13,414,432,000, 9
to remain available until September 30, 2025, may be 10
transferred to accounts under the headings ‘‘Operation 11
and Maintenance’’, ‘‘‘‘Procurement’’, and ‘‘Revolving and 12
Management Funds’’ for replacement, through new pro-13
curement or repair of existing unserviceable equipment, of 14
defense articles from the stocks of the Department of De-15
fense, and for reimbursement for defense services of the 16
Department of Defense and military education and train-17
ing, provided to or identified for provision to the Govern-18
ment of Ukraine or to foreign countries that have provided 19
support to Ukraine at the request of the United States: 20
Provided further, That up to $1,900,000,000, to remain 21
available until September 30, 2025, may be transferred 22
to accounts under the headings ‘‘Operation and Mainte-23
nance’’, ‘‘Procurement’’, and ‘‘Revolving and Management 24
Funds’’ for replacement, through new procurement or re-25

pair of existing unserviceable equipment, of defense arti-1
cles from the stocks of the Department of Defense, and 2
for reimbursement for defense services of the Department 3
of Defense and military education and training, provided 4
to or identified for provision to the Government of Taiwan 5
or to foreign countries that have provided support to Tai-6
wan at the request of the United States: Provided further, 7
That funds transferred pursuant to the preceding three 8
provisos shall be merged with and available for the same 9
purposes and for the same time period as the appropria-10
tions to which the funds are transferred: Provided further, 11
That the Secretary of Defense shall notify the congres-12
sional defense committees of the details of such transfers 13
not less than 15 days before any such transfer: Provided 14
further, That upon a determination that all or part of the 15
funds transferred from this appropriation are not nec-16
essary for the purposes provided herein, such amounts 17
may be transferred back and merged with this appropria-18
tion: Provided further, That any transfer authority pro-19
vided herein is in addition to any other transfer authority 20
provided by law: Provided further, That such amount is 21
designated by the Congress as being for an emergency re-22
quirement pursuant to section 251(b)(2)(A)(i) of the Bal-23

GENERAL PROVISIONS—THIS TITLE 1

EC. 1001. (a) Upon the determination of the Sec-2
retary of Defense that such action is necessary in the na-3
tional interest, the Secretary may, with the approval of 4
the Office of Management and Budget, transfer up to 5
$1,000,000,000 between the appropriations or funds made 6
available to the Department of Defense in this Act: Pro-7
vided, That the Secretary shall notify the Congress 8
promptly of each transfer made pursuant to the authority 9
in this paragraph: Provided further, That the authority 10
provided in this paragraph is in addition to any other 11
transfer authority otherwise provided by law and is subject 12
to the same terms and conditions as the authority pro-13
vided in section 8005 of the Department of Defense Ap-14
propriations Act, 2023, or any similar provision in any 15
subsequent Act making appropriations for the Department 16
of Defense for Fiscal Year 2024, except for monetary limi-17
tations concerning the amount of authority available. 18
(b) Upon the determination of the Secretary of De-19
fense that such action is necessary in the national interest, 20
the Secretary may, with the approval of the Office of Man-21
agement and Budget, transfer up to $250,000,000 of the 22
funds made available to the Director of National Intel-23
ligence for the National Intelligence Program in this Act 24
between such appropriations or funds or any subdivision 25

(e) Upon a determination that all or part of the funds 11
transferred pursuant to the authorities provided by this 12
section are not necessary for such purposes, such amounts 13
may be transferred back to such appropriations. 14

EC. 5008. Section 1705 of the Additional Ukraine 15
Supplemental Appropriations Act, 2023 (division M of 16
Public Law 117–328) shall apply to funds appropriated 17
by this Act under the heading ‘‘Economic Support Fund’’ 18

EC. 5009. None of the funds appropriated or other-20
wise made available by this title in this Act may be made 21
available for assistance for the Governments of the Rus-22
sian Federation or Belarus, including entities owned or 23

SEC. 5010. (a) Section 2606 of the Ukraine Supple-1
mental Appropriations Act, 2022 (division N of Public 2
Law 117–103) is amended as follows: 3
(1) in subsection (a), by striking ‘‘and North 4
Atlantic Treaty Organization (NATO) allies’’ and in-5
serting ‘‘, North Atlantic Treaty Organization 6
(NATO) allies, major non-NATO allies, and the 7
Indo-Pacific region’’; by striking ‘‘$4,000,000,000’’ 8
and inserting ‘‘$8,000,000,000’’; and by striking ‘‘, 9
except that such rate may not be less than the pre-10
vailing interest rate on marketable Treasury securi-11
ties of similar maturity’’; and 12
(2) in subsection (b), by striking ‘‘and NATO 13
allies’’ and inserting ‘‘, NATO allies, major non- 14
NATO allies, and the Indo-Pacific region; by strik-15
ing ‘‘$4,000,000,000’’ and inserting 16
‘‘$8,000,000,000’’; and by inserting at the end of 17
the second proviso ‘‘except for guarantees of loans 18

(b) Funds made available for the costs of direct loans 20
and loan guarantees for major non-NATO allies and the 21
Indo-Pacific region pursuant to section 2606 of division 22
N of Public Law 117–103, as amended by subsection (a), 23
may only be made available from funds appropriated by 24
this Act under the heading ‘‘Foreign Military Financing 25

Program’’ and available balances from under such heading 1
in prior Acts making appropriations for the Department 2
of State, foreign operations, and related programs: Pro-3
vided, That such funds may only be made available if the 4
Secretary of State certifies and reports to the appropriate 5
congressional committees, not less than 15 days prior to 6
the obligation of such funds, that such direct loan or loan 7
guarantee is in the national security interest of the United 8
States, is being provided in response to exigent cir-9
cumstances, is addressing a mutually agreed upon emer-10
gency requirement of the recipient country, and the recipi-11
ent country has a plan to repay such loan: Provided fur-12
ther, That not less than 60 days after the date of enact-13
ment of this Act, the Secretary of State shall consult with 14
such committees on the implementation of this subsection. 15
(c) Amounts repurposed pursuant to this section that 16
were previously designated by the Congress as an emer-17
gency requirement pursuant to a concurrent resolution on 18
the Budget are designated as an emergency requirement 19
pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-20
et and Emergency Deficit Control Act of 1985. 21

EC. 5011. Funds appropriated under the headings 22
‘‘Economic Support Fund’’ and ‘‘Assistance for Europe, 23
Eurasia and Central Asia’’ in this title in this Act may 24

EC. 5012. None of the funds appropriated or other-3
wise made available by this division and division B of this 4
Act, and prior Acts making appropriations for the Depart-5
ment of State, foreign operations, and related programs, 6
may be made available for a contribution, grant, or other 7
payment to the United Nations Relief and Works Agency, 8
notwithstanding any other provision of law. 9

EC. 5013. (a) CERTIFICATION.—The Secretary of 10
State shall certify and report to the appropriate congres-11
sional committees not later than March 1, 2024, that— 12
(1) oversight policies, processes, and procedures 13
have been established by the Department of State 14
and the United States Agency for International De-15
velopment, as appropriate, and are in use to prevent 16
the diversion, misuse, or destruction of assistance, 17
including through international organizations, to 18
Hamas and other terrorist and extremist entities in 19
Gaza; and 20
(2) such policies, processes, and procedures 21
have been developed in coordination with other bilat-22
eral and multilateral donors and the Government of 23
Israel, as appropriate. 24

(b) OVERSIGHTPOLICY ANDPROCEDURES.—The 1
Secretary of State and the USAID Administrator shall 2
submit to the appropriate congressional committees, con-3
current with the submission of the certification required 4
in subsection (a), a written description of the oversight 5
policies, processes, and procedures for funds appropriated 6
by this title that are made available for assistance for 7
Gaza, including specific actions to be taken should such 8
assistance be diverted, misused, or destroyed, and the role 9
of Israel in the oversight of such assistance. 10
(c) R
EQUIREMENT TOINFORM.—The Secretary of 11
State and USAID Administrator shall promptly inform 12
the appropriate congressional committees of each instance 13
in which funds appropriated by this title that are made 14
available for assistance for Gaza have been diverted, mis-15
used, or destroyed, to include the type of assistance, a de-16
scription of the incident and parties involved, and an ex-17
planation of the response of the Department of State or 18
USAID, as appropriate. 19
(d) T
HIRD-PARTYMONITORING.—Funds appro-20
priated by this title shall be made available for third-party 21
monitoring of assistance for Gaza, including end use moni-22
toring, following consultation with the appropriate con-23
gressional committees. 24

EPORT.—Not later than 90 days after the initial 18
obligation of funds appropriated by this title that are 19
made available for assistance for Gaza, and every 90 days 20
thereafter until all such funds are expended, the Secretary 21
of State and the USAID Administrator shall jointly sub-22
mit to the appropriate congressional committees a report 23
detailing the amount and purpose of such assistance pro-24

vided during each respective quarter, including a descrip-1
tion of the specific entity implementing such assistance. 2
(g) A
SSESSMENT.—Not later than 90 days after the 3
date of enactment of this Act and every 90 days thereafter 4
until September 30, 2025, the Secretary of State, in con-5
sultation with the Director of National Intelligence and 6
other heads of elements of the intelligence community that 7
the Secretary considers relevant, shall submit to the ap-8
propriate congressional committees a report assessing 9
whether funds appropriated by this title and made avail-10
able for assistance for the West Bank and Gaza have been 11
diverted by Hamas or other terrorist and extremist enti-12
ties in the West Bank and Gaza: Provided, That such re-13
port shall include details on the amount and how such 14
funds were made available and used by such entities: Pro-15
vided further, That such report may be submitted in classi-16
fied form, if necessary. 17
(h) C
ONSULTATION.—Not later than 30 days after 18
the date of enactment of this Act but prior to the initial 19
obligation of funds made available by this title for humani-20
tarian assistance for Gaza, the Secretary of State and 21
USAID Administrator, as appropriate, shall consult with 22
the Committees on Appropriations on the amount and an-23
ticipated uses of such funds. 24

SEC. 5014. Prior to the initial obligation of funds 1
made available in this title in this Act, the Secretary of 2
State, USAID Administrator, and the Secretary of the 3
Treasury, as appropriate, shall submit to the Committees 4

(1) spend plans, as defined in section 6
7034(s)(4) of the Department of State, Foreign Op-7
erations, and Related Programs Appropriations Act, 8
2023 (division K of Public Law 117–328), at the 9
country, account, and program level, for funds ap-10
propriated by this Act under the headings ‘‘Eco-11
nomic Support Fund’’, ‘‘Transition Initiatives’’, ‘‘As-12
sistance for Europe, Eurasia and Central Asia’’, 13
‘‘International Narcotics Control and Law Enforce-14
ment’’, ‘‘Nonproliferation, Anti-terrorism, Demining 15
and Related Programs’’, ‘‘Peacekeeping Oper-16
ations’’, ‘‘Foreign Military Financing Program’’, and 17
‘‘Contribution to the International Development As-18
sociation’’: Provided, That plans submitted pursuant 19
to this paragraph shall include for each program no-20
tified—(A) total funding made available for such 21
program, by account and fiscal year; (B) funding 22
that remains unobligated for such program from 23
prior year base or supplemental appropriations; (C) 24
funding that is obligated but unexpended for such 25
