Provided further, That any congressional no-16 tification requirement applicable to funds made available 17 under this heading in this Act for Israel may be waived 18 if the Secretary of State determines that to do so is in 19 the national security interest of the United States: Pro-20 vided further, That up to $5,000,000 of funds made avail-21 able under this heading in this Act, in addition to funds 22 otherwise available for such purposes, may be used by the 23 Department of State for necessary expenses for the gen-24 eral costs of administering military assistance and sales, During fiscal year 2024, up to 8 $250,000,000 of funds deposited in the Consular and Bor-9 der Security Programs account in any fiscal year that are 10 available for obligation may be transferred to, and merged 11 with, funds appropriated by any Act making appropria-12 tions for the Department of State, foreign operations, and 13 related programs under the headings ‘‘Diplomatic Pro-14 grams’’ (including for Worldwide Security Protection) and 15 ‘‘Emergencies in the Diplomatic and Consular Service’’ for 16 emergency evacuations or to prevent or respond to security 17 situations and related requirements: Provided, That such 18 transfer authority is in addition to any other transfer au-19 thority provided by law, and any such transfers are subject 20 to prior consultation with, and the regular notification 21 procedures of, the Committees on Appropriations. 22 S EC. 302. During fiscal year 2024, section 3 506(a)(2)(B) of the Foreign Assistance Act of 1961 (22 4 U.S.C. 2318(a)(2)(B)) shall be applied by substituting 5 ‘‘$400,000,000’’ for ‘‘$200,000,000’’ in the matter pre-6 ceding clause (i), and by substituting ‘‘$150,000,000’’ for 7 ‘‘$75,000,000’’ in clause (i). 8 S EC. 304. During fiscal year 2024, section 552(c)(2) 9 of the Foreign Assistance Act of 1961 (22 U.S.C. 10 2348a(c)(2)) shall be applied by substituting 11 ‘‘$50,000,000’’ for ‘‘$25,000,000’’. 12 S EC. 305. Section 12001 of the Department of De-13 fense Appropriations Act, 2005 (Public Law 108–287) is 14 amended as follows: 15 (1) In paragraph (2) of subsection (a), by strik-16 ing ‘‘armor’’ and all that follows through the end of 17 the paragraph and inserting ‘‘defense articles that 18 are in the inventory of the Department of Defense 19 as of the date of transfer, are intended for use as 20 reserve stocks for Israel, and are located in a stock-21 pile for Israel as of the date of transfer’’. 22 (2) In subsection (b), by striking ‘‘at least 23 equal to the fair market value of the items trans-24 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00015 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 16 •HR 8034 IH ferred’’ and inserting ‘‘in an amount to be deter-1 mined by the Secretary of Defense’’. 2 (3) In subsection (c), by inserting before the 3 comma in the first sentence the following: ‘‘, or as 4 far in advance of such transfer as is practicable as 5 determined by the President on a case-by-case basis 6 during extraordinary circumstances impacting the 7 national security of the United States’’. 8 S EC. 306. For fiscal year 2024, section 514(b) of the 9 Foreign Assistance Act of 1961 (22 U.S.C. 2321h(b)) 10 shall not apply to defense articles to be set aside, ear-11 marked, reserved, or intended for use as reserve stocks 12 in stockpiles in the State of Israel. 13 S EC. 307. (a) Funds appropriated by this Act under 14 the headings ‘‘International Disaster Assistance’’ and 15 ‘‘Migration and Refugee Assistance’’ may be transferred 16 to, and merged with, funds appropriated by this Act under 17 such headings. 18 (b) Funds appropriated by this Act under the head-19 ings ‘‘International Narcotics Control and Law Enforce-20 ment’’, ‘‘Peacekeeping Operations’’, and ‘‘Foreign Mili-21 tary Financing Program’’ may be transferred to, and 22 merged with, funds appropriated by this Act under such 23 headings. 24 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 17 •HR 8034 IH (c) The transfer authorities provided by this section 1 are in addition to any other transfer authority provided 2 by law, and are subject to prior consultation with, and 3 the regular notification procedures of, the Committees on 4 Appropriations. 5 (d) Upon a determination that all or part of the funds 6 transferred pursuant to the authorities provided by this 7 section are not necessary for such purposes, such amounts 8 may be transferred back to such appropriations. 9 S EC. 308. None of the funds appropriated or other-10 wise made available by this Act and prior Acts making 11 appropriations for the Department of State, foreign oper-12 ations, and related programs may be made available for 13 a contribution, grant, or other payment to the United Na-14 tions Relief and Works Agency, notwithstanding any other 15 provision of law. 16 S EC. 309. (a) CERTIFICATION.—The Secretary of 17 State shall certify and report to the appropriate congres-18 sional committees not later than fifteen days after the date 19 of enactment of this Act, that— 20 (1) oversight policies, processes, and procedures have 21 been established by the Department of State and the 22 United States Agency for International Development, as 23 appropriate, and are in use to prevent the diversion, mis-24 use, or destruction of assistance, including through inter-25 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 18 •HR 8034 IH national organizations, to Hamas and other terrorist and 1 extremist entities in Gaza; and 2 (2) such policies, processes, and procedures have been 3 developed in coordination with other bilateral and multi-4 lateral donors and the Government of Israel, as appro-5 priate. 6 (b) O VERSIGHTPOLICY ANDPROCEDURES.—The 7 Secretary of State and the USAID Administrator shall 8 submit to the appropriate congressional committees, con-9 current with the submission of the certification required 10 in subsection (a), a written description of the oversight 11 policies, processes, and procedures for funds appropriated 12 by this title that are made available for assistance for 13 Gaza, including specific actions to be taken should such 14 assistance be diverted, misused, or destroyed, and the role 15 of Israel in the oversight of such assistance. 16 (c) R EQUIREMENT TO INFORM.—The Secretary of 17 State and USAID Administrator shall promptly inform 18 the appropriate congressional committees of each instance 19 in which funds appropriated by this title that are made 20 available for assistance for Gaza have been diverted, mis-21 used, or destroyed, to include the type of assistance, a de-22 scription of the incident and parties involved, and an ex-23 planation of the response of the Department of State or 24 USAID, as appropriate. 25 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00018 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 19 •HR 8034 IH (d) THIRDPARTYMONITORING.—Funds appro-1 priated by this title shall be made available for third party 2 monitoring of assistance for Gaza, including end use moni-3 toring, following consultation with the appropriate con-4 gressional committees. 5 (e) O FFICES OFINSPECTORSGENERAL.— 6 (1) D EPARTMENT OF STATE.—Of the funds appro-7 priated by this title under the heading ‘‘Office of Inspector 8 General’’ for the Department of State, $4,000,000 shall 9 be made available for the oversight and monitoring of as-10 sistance made available for Gaza by this title and in prior 11 Acts making appropriations for the Department of State, 12 foreign operations, and related programs. 13 (2) U NITEDSTATESAGENCYFORINTERNATIONAL 14 D EVELOPMENT.—Of the funds appropriated by this title 15 under the heading ‘‘Office of Inspector General’’ for 16 USAID, $3,000,000 shall be made available for the over-17 sight and monitoring of assistance made available for 18 Gaza by this title and in prior Acts making appropriations 19 for the Department of State, foreign operations, and re-20 lated programs. 21 (f) R EPORT.—Not later than 90 days after the initial 22 obligation of funds appropriated by this title that are 23 made available for assistance for Gaza, and every 90 days 24 thereafter until all such funds are expended, the Secretary 25 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00019 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 20 •HR 8034 IH of State and the USAID Administrator shall jointly sub-1 mit to the appropriate congressional committees a report 2 detailing the amount and purpose of such assistance pro-3 vided during each respective quarter, including a descrip-4 tion of the specific entity implementing such assistance. 5 (g) A SSESSMENT.—Not later than 90 days after the 6 date of enactment of this Act and every 90 days thereafter 7 until September 30, 2025, the Secretary of State, in con-8 sultation with the Director of National Intelligence and 9 other heads of elements of the intelligence community that 10 the Secretary considers relevant, shall submit to the ap-11 propriate congressional committees a report assessing 12 whether funds appropriated by this title and made avail-13 able for assistance for the West Bank and Gaza have been 14 diverted by Hamas or other terrorist and extremist enti-15 ties in the West Bank and Gaza: Provided, That such re-16 port shall include details on the amount and how such 17 funds were made available and used by such entities: Pro-18 vided further, That such report may be submitted in classi-19 fied form, if necessary. 20 (h) C ONSULTATION.—Not later than 30 days after 21 the date of enactment of this Act but prior to the initial 22 obligation of funds made available by this title for humani-23 tarian assistance for Gaza, the Secretary of State and 24 USAID Administrator, as appropriate, shall consult with 25 VerDate Sep 11 2014 00:24 Apr 18, 2024 Jkt 049200 PO 00000 Frm 00020 Fmt 6652 Sfmt 6201 E:\BILLS\H8034.IH H8034 ssavage on LAPJG3WLY3PROD with BILLS 21 •HR 8034 IH the Committees on Appropriations on the amount and an-1 ticipated uses of such funds. 2 S EC. 310. Each amount appropriated or made avail-3 able by this Act is in addition to amounts otherwise appro-4 priated for the fiscal year involved. 5 S EC. 402. No part of any appropriation contained in 6 this Act shall remain available for obligation beyond the 7 current fiscal year unless expressly so provided herein. 8 S EC. 403. Unless otherwise provided for by this Act, 9 the additional amounts appropriated by this Act to appro-10 priations accounts shall be available under the authorities 11 and conditions applicable to such appropriations accounts 12 for fiscal year 2024. 13 S EC. 404. Funds appropriated by this Act for foreign 6 assistance (including foreign military sales), for the De-7 partment of State, for broadcasting subject to supervision 8 of United States Agency for Global Media, and for intel-9 ligence or intelligence related activities are deemed to be 10 specifically authorized by the Congress for the purposes 11 of section 10 of Public Law 91–672 (22 U.S.C. 2412), 12 section 15 of the State Department Basic Authorities Act 13 of 1956 (22 U.S.C. 2680), section 313 of the Foreign Re-14 lations Authorization Act, Fiscal Years 1994 and 1995 15 (22 U.S.C. 6212), and section 504(a)(1) of the National 16 Security Act of 1947 (50 U.S.C. 3094(a)(1)). 17 S EC. 406.
