To prohibit the disbursement of Federal funds to State and
local governments that allow individuals who are not
citizens of the United States to vote in any Federal,
State, or local election.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting Our Democ-4
racy by Preventing Foreign Citizens from Voting Act of 5
2023’’. 6

SEC. 2. FEDERAL PAYMENT RESTRICTION. 1
(a) I
NGENERAL.—Notwithstanding any other provi-2
sion of law, no Federal funds may be made available to 3
any State or local government if such State or local gov-4
ernment allows individuals who are not citizens of the 5
United States to vote in any Federal, State, or local elec-6
tion. 7
(b) C
ERTIFICATION.—Upon application, approval, 8
and receipt of any Federal funds, a State or local govern-9
ment shall certify that the State or local government does 10
not permit individuals who are not citizens of the United 11
States to vote in any Federal, State, or local election. 12
(c) A
PPLICABILITY.—The requirements of this sec-13
tion shall only apply with respect to any contract entered 14
into or grant made on or after the date of the enactment 15
of this Act. 16
