To amend title 10, United States Code, to prohibit the estab-
lishment or maintenance of a unit of the Junior Reserve
Officers’ Training Corps at an educational institution
owned, operated, or controlled by the Chinese Communist
Party.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Deterring Egregious 4
State Infiltration of Schools’ Training Act’’. 5

SEC. 2. PROHIBITION OF ESTABLISHMENT OR MAINTE-1
NANCE OF A UNIT OF THE JUNIOR RESERVE 2
OFFICERS’ TRAINING CORPS AT AN EDU-3
CATIONAL INSTITUTION OWNED, OPERATED, 4
OR CONTROLLED BY THE CHINESE COM-5
MUNIST PARTY. 6
Section 2031 of title 10, United States Code, is 7
amended by adding at the end the following new sub-8
section: 9
‘‘(i) No unit may be established or maintained at an 10
educational institution that is owned, operated, or con-11
trolled by a person that— 12
‘‘(1) is the People’s Republic of China; 13
‘‘(2) is a member of the Chinese Communist 14
Party; 15
‘‘(3) is a member of the People’s Liberation 16
Army; 17
‘‘(4) is identified by the Secretary of Defense 18
under section 1260H(a) of the William M. (Mac) 19
Thornberry National Defense Authorization Act for 20
Fiscal Year 2021 (10 U.S.C. 113 note) as a Chinese 21
military company; 22
‘‘(5) is included in the Non-SDN Chinese Mili-23
tary-Industrial Complex Companies List published 24
by the Department of the Treasury; or 25

‘‘(6) is owned by or controlled by or is an agen-1
cy or instrumentality of any person described in 2
paragraphs (1) through (5).’’. 3
